  3. INTRODUCTION There are literally thousands of people attempting to enter United States on a work visa. It is not an easy task to get a United States work visa. There are several types of work visas available and each one requires a specific skill set and other qualification criteria. This article briefly explores the nuances behind obtaining a United States work visa.

  4. Types of US Work Visas A work visa is approved on a temporary basis and is also known as non-immigrant visa. An employer, on behalf of the applicant, applies for a work visa. The employer files a petition with the United States Citizenship and Immigrant Services (USCIS). After the petition is approved, the employee applies for a visa at the US Consulate in his or her country. The approved visa allows the employee to travel to United States and work for the employer. The following types of visas are available for employers to bring a foreign national to the United States.

  5. H1B1 This is similar to H1B and applies to individuals from Chile and Singapore under the FTA (Free Trade Agreement).

  7. H2A Temporary Agricultural worker, limited to citizens from certain countries.

  11. O Allows entry for individuals with extra ordinary talent in areas such as movies, TV, athletics, etc.

  12. P1, P2, P3 Allows entry for individuals or group of individuals for the purposes of performing at an athletic, artistic or entertainment event

Application Process The application process for each of the above types of visas is more or less the same. • Employer submits the I-129 or the petition for a work permit to USCIS.• Employer may also be required to obtain a labor certification from the Department of Labor. • Employee provides supporting documents such as copies of experience certificates, educational credentials, proof of foreign citizenship and proof of birth, all of which will be submitted as part of the I-129 package.• USCIS approves, denies or requests additional information after processing the I-129 petition. • If the petition is approved, then the applicant may use the approval notice to schedule a visa interview at the designated US consulate in his country. • The applicant must pay a fee of $190 and also provide supporting documents such as a valid passport, visa application and photos. • The applicant attends the visa interview at the Consulate and gets the visa stamped on the passport.
