Agenda Item 4.3 (Russ Shields input)Security and Lawful Intercept • The ability of authorities to proactively intercept communications in the interests of public safety and law enforcement, given appropriate prior authorization • Application is already well-established for traditional voice calls (“wire tapping” under court permit) • Precedents are beginning to appear for stationary VoIP • Public safety and law enforcement agencies will require the ability to intercept information from vehicles • Data messages from a particular vehicle or all vehicles in an area • Voice transmission, including ability to switch on an in-vehicle device to capture conversations in the vehicle • Guidance needed for appropriate practices in this area • ISO/TC204/WG16 is already exploring the tradeoff

Agenda Item 4.3 (Russ Shields continued input)Security and Lawful Intercept • Contribution to Agenda Item 4.3: Security and Lawful Interception • Lawful Intercept is the ability of the authorities to intercept communications in the interests of public safety and law enforcement, given appropriate prior authorization, typically from the courts, based on probable cause. This authority is already well established for traditional landline and cellular voice calls (court authorized wire tapping), and precedents have begun to appear for calls made using stationary voice over Internet protocol (VoIP). • It seems clear that public safety and law enforcement agencies will establish their right to similarly intercept mobile communications. This will likely take two forms: • Interception of data messages from vehicles which report on the location and behavior of the vehicle. The ability will be required to intercept messages from particular vehicles or from all vehicles in an area, including the ability to direct the vehicles to begin transmitting messages that provide particular kinds of information • Interception of voice transmission, including the ability to direct an in-vehicle device to capture and transmit conversation in the vehicle • Public agencies’ need for lawful intercept trades off against personal privacy concerns. There is need for clear guidance for appropriate practice in this area. While the characteristics of lawful intercept will undoubtedly differ from one global location to another, internationally recognized practices and guidelines would be helpful. ISO/TC204/WG16 is initiating a work item in this area.
