Legislative Framework • Disability Discrimination Act 1995 • Human Rights Act 2000 • The Special Educational Needs and Disability Bill 2001
SEN and Disability Bill 2001 • ‘comprehensive enforceable civil rights’ for disabled people in pre- and post-16 education in England, Scotland and Wales. It has major implications for further and higher education institutions, for the way the curriculum is delivered and students are supported. The law will make it unlawful to discriminate against a disabled person with regard to: • admissions • the services the college provides to students
SEN and Disability Bill 2001 • The law makes it unlawful to discriminate against disabled people in the provision of services, recreational and training facilities. • A number of areas where ‘reasonable’ adjustments need to be made: • Admission and enrolment • administrative and examination procedures • Course content and work placements
SEN and Disability Bill 2001 • Physical features of premises • Teaching arrangements and methods • Arrangement of support services • Provision of information in alternative formats • An anticipatory dutyInstitutions will be expected to anticipate the needs of disabled students and applicants in making their provision accessible.
