  4. SAFETEA-LU SAFETEA-LU authorizes funding for surface transportation programs highways, transit and highway safety programs for fiscal years 2005–2009

  5. FUNDING SAFETEA-LU $286.5 billion (FY05-FY09) • $228 billion for highway programs • $52 billion for transit programs • $6 billion for highway safety programs Funding includes $22 billion in congressional earmarks!!

  6. FUNDING • (New) Equity Bonus Program–replaces Minimum Guarantee program • States guaranteed 92 percent rate of return by 2008 • States expected to receive approximately 19 percent more than what was received under TEA-21

FINANCING • Revenue Aligned Budget Authority (RABA) maintained, but tweaked • Authorizes financing commissions and studies: • National Surface Transportation Infrastructure Financing Commission • National Surface Transportation Policy Study Commission • Motor Fuel Tax Enforcement Advisory Commission • Road User Fees Study

  8. HIGHWAY PROGRAMS • Congestion Mitigation Air Quality Improvement Program-$8.7 b • Highway Bridge Program-$21.6 b • (New) Highway Safety Improvement Program-$5.1 b • National Highway System Program -$30.5 b • Surface Transportation Program-$32.5 b • Interstate Maintenance Program-$25.2 b

TRANSIT FUNDING • $52 billion overall transit funding • $19.1 billion for urbanized formula grants • $1.9 billion for non-urban areas • $1.7 billion in formula funding for growing and high density states • $8 billion for Major Capital Investment Grants “New Starts” • (new) Small Starts Grant Program ($200 million annual aside) • (new) New Freedom Initiative

SAFETY Establishes $5.1 billion New Highway Safety Improvement Program (HSIP) • $220 million annual set aside for railway-highway grade crossing program • $90 million annual set aside for construction and operational improvements on high-risk rural roads. • Remainder of funds distributed by formula

  11. SAFETY-SHSP State Strategic Highway Safety Plan (SHSP) • State plans due by October 2007 or states subject to penalties • Annual reporting requirements • Subject to triennial review by NHTSA • State may use up to 10 percent of HSIP funds to carry out safety projects in SHSP

  12. SAFETY-OTHER • $612 million Safe Routes to School Program • Work Zone Safety Program • Traffic Signal Preemption • Other provisions focused on road safety improvements for older drivers and pedestrians

  13. SAFETY-NHTSA • Highway Safety Research and Outreach Program ($502) • State Traffic Safety Information System Improvements Incentive Grant Program ($34.5 million) • Joint NHTSA-FMSA outreach and education program

  14. PROJECT STREAMLINING • US DOT designated lead agency • Inclusion of “participating agencies” • 30-day issue resolution • 180-day statute of limitations for judicial review • Project Delivery Pilot Program

PLANNING • Same planning procedures for metropolitan and statewide planning • Requires a greater amount of consultation and coordination from other entities/interests affected by transportation • Includes 4-year update cycles for long-range transportation plans in non-attainment and maintenance areas and state and metropolitan transportation improvement programs • Transportation management areas are required to be certified no less than every 4 years. • 30 days for states to reimburse MPOs for PL fund expenditures
