Sexual Harassment Defined • Sexual Harassment: unwelcomed advances, requests for sexual favors, and other verbal or physical harassment of sexual nature. • It is illegal to harass a person because of that person’s sex. • A harasser can be male or female, and the victim can be of the same sex. • Harassment does not have to be sexual in nature, but it includes offensive remarks about a person’s sex.

  4. Teasing, offhand comments, and isolated incidents are not tolerated, especially harassment that is frequent and serious enough to create an offensive hostile work environment. This includes any adverse affect of the harassment such as being fired or demoted. The harasser can be anyone in the workplace, including supervisors, co-workers, and even clients/customers. The victim doesn’t have to be the person harassed, bystanders can be affected by the offensive conduct. Sexual Harassment Defined (continued…) 4

  5. Quid Pro Quo: (meaning “this for that”) is a type of sexual harassment where a superior bases an employee’s job status on whether they submit to an unwelcomed sexual act. Example: A manager promises a promotion to John Doe if he has sexual relations with her. Hostile Environment: verbal, visual, or physical form of harassment that is sexual in nature that is unwelcomed and is severe, persistent, or pervasive. A single severe incident can create a hostile work environment. Example: Jane Doe hates going to work everyday to have one of her co-workers make comments about her looks and points to a nude photo on his phone commenting that he’d like a picture of her.   6. Sexual Harassment is a form of discrimination that violates Title VII of the Civil Rights Act of 1964 Title VII applies to employers with 15 or more employees. It also applies to labor agencies, employment agencies, and the federal government. 180 days to file a charge, unless extended by state laws. Federal employees have 45 days to contact an EEOC Counselor. It is illegal to retaliate against anyone who is reporting, testifying, or participating in allegations toward someone for harassment.   7. While we understand how uncomfortable it may be to discuss a harassment situation, in order for us to effectively resolve harassment situations, we need know when they are occurring. Employees must report the incident(s) as soon as possible to their supervisors, a member of management, or Human Resources. LGSTX will conduct a prompt, thorough, confidential investigation for each claim of harassment. Reporting Harassment 7

Overview LGSTX Services, Inc, is committed to maintaining a work environment that is pleasant, safe, comfortable, and free from intimidation, hostility, or other offenses that might interfere with your ability to do your job. Harassment of any kind (verbal, physical, visual, or sexual) will not be tolerated and will lead to disciplinary action, up to and including termination. Core Requirements Harassment, whether committed by members of management, non-supervisory personnel, customers, or other persons, will not be tolerated in the workplace at LGSTX Services. Any employee who reports harassment is assured a prompt, thorough, and discreet investigation. Harassment is judged to be offensive by the victim’s perception – not that of the alleged harasser. Harassment can exist if the harasser does not intend to harass, but the victim perceives it as such. It is against the law and our policy to retaliate in any way against the person(s) coming forward with a harassment allegation or providing information to an investigation.
