  2. Impacts to Federal Funding • IDOE released a memosharing federal funding updates and information on the equitable share. Access the memo at http://tinyurl.com/fiscalupdates. • SY 2017-2018 appropriations have not been finalized. • Equitable services provisions have changed for Title I, A and Title II.

Designing a Program and Determining Equitable Services • New ESSA requires that the Title I, Part A proportionate share for equitable services be calculated prior to allocating for any expenditures or transfer of funds. This includes any “off the top” funds, such as administrative costs, parent involvement, and district-wide initiatives. • The needs of the non-public school students and teachers must be assessed and evaluated. • Services must be allowable and comparable to those provided to public school students and teachers participating in the program, but are not required to be the exact same Title I service.

  5. Designing a Program and Determining Equitable Services • No funds are provided directly to non-public schools. • Funds, materials, and equipment generated by the non-public school’s per pupil allocation must be managed and retained by the LEA.

Designing a Program and Determining Equitable Services IDEA, Part B Proportionate Share • LEA must expend proportionate share of Part B funds on equitable services for parentally placed private school children with disabilities. • Includes: • Students parentally placed in non-public schools, • all homeschooled students, • students with disabilities who attend non-public schools via vouchers (reported on the SV) but choose to have services rendered by the non-public school

Designing a Program and Determining Equitable Services IDEA, Part B Proportionate Share • LEA with jurisdiction over the district where non-public school is located is responsible for implementing IDEA requirements for parentally placed students with disabilities (34 CFR 300.131-300.132) • Calculated in both 611 & 619 grants (templates will auto-calculate for you) • Co-ops/Interlocals/Joint Services cannot comingle funds between corporations; LEAs must expend proportionate share on non-public schools within own jurisdictions

Designing a Program and Determining Equitable Services IDEA, Part B Proportionate Share • Quarterly Report for LEAs with calculated proportionate share from 611 and/or 619 grant • Expenditures & costs to date by LEA • Description of how proportionate share funds were expended during the given reporting period • List of materials & supplies purchased for non-public students • Explanation detailing how students with ISPs will continue to receive services if proportionate share is expended before grant period ends

What is Consultation? • Consultation involves discussions between public and private school officials on key issues that affect the ability of eligible private school students to participate equitably in Title I programs. Effective consultation provides a genuine opportunity for all parties to express their views and to have those views considered. Successful consultation establishes positive and productive working relationships that make planning easier and ensure that the Title I services provided meet the needs of eligible students. (§1120(b) of the Title I statute and §200.63 of the Title I regulations)

Title II: Calculating Equitable Share • Under NCLB, the equitable share was based upon LEA funding dedicated to professional development or the FY 2001 Eisenhower professional development and class size reduction programs, whichever was higher. • Under ESSA, the equitable share is calculated based on the entire allocation, whether funding is used for professional development, teacher evaluation, class size reduction, and/or incentives.

Carryover Dollars – Unexpended Equitable Share • In general, to ensure that equitable services are provided in a timely manner, an LEA must obligate the funds allocated for equitable services under all applicable programs in the year for which they are appropriated. (ESEA sections 1117(a)(4)(B) and 8501(a)(4)(B).) • The unexpended funds should remain available for the provision of equitable services under the respective program during the subsequent school year. In determining how such carryover funds will be used, the LEA must consult with appropriate non-public school officials. (ESEA sections 1117(b) and 8501(c).)

Title I Services from Multiple LEAs • Consultation with LEAs and non-public school • The equitable share for eligible students is transferred to the Lead LEA • The Lead LEA agrees to implement and oversee Title I services on behalf of all LEAs • Participating LEAs transfer the equitable share (paid on Invoice) to the Lead LEA
