  2. INTRODUCTION • Thank you for the opportunity to make this presentation before the PPPC • What the country wants to achieve • Effective competition • Affordable telecomms services • Superior services to our people • Deliver communications to South Africans STRONG REGULATOR NECESSARY SNO

  3. SECTOR INTEREST • Operator investment is facilitated by stable / robust regulatory environment • Regulatory certainty facilitates growth in the sector SNO

  4. KEY CONCERNS • Independence • Capacity / funding • Complaints and Compliance Committee SNO

  5. RECOMMENDATIONS • Independence • Separate line ministries • Appointment / removal of councillors by organ of state other than the line ministry • Performance management system overseen by non-line ministry • ICASA should have the sole discretion to appoint non-SA consultants SNO

  6. RECOMMENDATIONS • Capacity / financing • ICASA to retain portion of licence fees [PFMA, s13(3)] OR • Budget determined by a different organ of state from line ministry responsible for shareholder management function (Ministry of Finance only?) SNO

  7. RECOMMENDATIONS • Complaints and Compliance Committee • Referral and investigation of complaints • Referral to ICASA • Investigations by inspectors • Jurisdiction over licensees and non-licensees • Adjudication • Tribunal structure ideal • Review • Review to the High Court SNO
