  1. Criminal ProceduresTransfer For TreatmentDirection MH 136 • Serving prisoner • 2 doctors – 1 AMP • There is mental disorder requiring treatment • Restricted • Only valid for duration of custodial sentence.

  2. TTDs • Short Term Prisoners – Under 4 years • Long Term Prisoners – Over 4 years • Life Prisoners

  3. TTDs - Long Term Prisoners • Parole Qualifying Date (PQD) at half sentence • Earliest Date of Liberation (EDL) at 2/3 sentence • Sentence Expiry Date (SED) Full sentence

  4. TTDs - Long Term Prisoners • Release between PQD and EDL, subject to parole licence conditions • Release at EDL subject to non–parole licence conditions • Recall by Parole Board for breach

  5. TTDs – Life Prisoners • Subject to Life Licence • Sentence Tariff but no automatic release • Life Licence Tribunal • Release on life licence conditions • Recall by Tribunal at any time

  6. TTDs – EDLs • Decision re CTO within 8 weeks of EDL • Full CTO must be granted prior to EDL • No Interim CTOs • CTO takes effect from date of EDL • Significant impairment test applies
