  3. FEDERAL FUNDING Federal funding very uncertain at this time. CRs for SAFETEA-LU Obligational Authority to ~ $217M Only $74M in apportionment resulting from CRs Adding carryover apportionment gives ~ $143M Apportionment in certain categories, limits us.

  4. FEDERAL FUNDING Work with cities, counties, and consultants - ensure we spend anticipated $235M ~ $80M of 2009 ARRA in 2010 ER work in Devils Lake basin – unsure how much. Prepared for possible JOBS bill work.

  5. CONSTRUCTION PROGRAM • Moved 22 Regular Federal Aid projects from April 16, to April 23, for a total of $29,199,000.  Includes 4 Urban projects. • Moved 3 H-MDF projects from April 16, to April 23, for a total of $7,335,000. • Moved ND19 and ND57 (DL, ER) from April 16 bid to April 23 plans completion, for a total of $66,036,000.

CONSTRUCTION PROGRAM • Moved 1 I-29 ER project (Fencing, Debris Removal, ditch Block) from April 16, to April 23, for a total of $88,000 • Total amount moved out of April 16, bid opening 28 projects worth $102,658,000. • Depending upon the funding situation, these projects may need to be moved again.

  7. CONSTRUCTION QUALITY • 105.09 AUTHORITY OF THE ENGINEER. • The Engineer has the authority to suspend the work wholly or in part for: 1) the Contractor’s failure to carry out Contract provisions; 2) for failure to carry out orders; 3) for periods of unsuitable weather; 4) for conditions considered unsuitable for prosecution of the work; 5) for other conditions or reasons in the public interest; or 6) for other reasons that are mutually agreed on by the parties to the Contract.

  8. CONSTRUCTION QUALITY • 105.09 AUTHORITY OF THE ENGINEER. • As the Department’s direct representative, the Field Engineer is delegated authority for immediate charge of engineering details of the construction Project and the administrative responsibilities for the satisfactory completion of the Project. The Field Engineer has authority to reject defective material or work not meeting Contract requirements. The Field Engineer is not authorized to alter or waive provisions of the Contract unless approved by Construction Change Order.

  9. CONSTRUCTION QUALITY • NDDOT - CONSULTANT SERVICES CONSTRUCTION AGREEMENT • The Engineer shall perform the needed construction engineering work such as, but not limited to, staking, cross sectioning, inspection, sampling and testing of materials, and measuring and computing pay quantities. The Engineer shall prepare the engineering and administrative documents and records as required by NDDOT. It is the Engineer's responsibility to perform construction inspections to verify the contractor's work is performed according to the governing specifications, plans, and special provisions including, but not limited to, the provisions of NDDOT's Standard Specifications for Road and Bridge Construction, Materials Sampling and Testing Manual, Construction Records Manual, and Construction Manual.

  10. CONSTRUCTION QUALITY PLAN CHECKING • Last line of checks. • Think about constructing project when reviewing the plans. • Quantities (Dirt, SF vs SY), Black Box • Notes • Bring concerns forward. PARTNERING

  11. CONSTRUCTION QUALITY • PE OVERSIGHT • Field changes which affect functional design must be done by original registrant. • All construction projects require some type of PE oversight.

  12. ENVIRONMENTAL REVIEWS • Make sure you know commitments and we follow them. • Additions or changes need clearance or proper permitting. • Possibly big penalties if not followed. • Know boundaries .

  14. ARRA PROJECT REVIEWS Required Contract Provisions - Form FHWA-1273 The Required Contract Provisions for Federal-aid Construction Contracts must be incorporated in all construction contracts, subcontracts and in any lower tier subcontracts. Incorporation by reference is not acceptable.
