  2. DANGERS OF IRREGULAR MIGRATION • Irregular migrants are exposed to many dangers, as well as to the conditions they find in the country of destination. • A high number of irregular migrants live and work under difficult conditions: • Exploitation. • Risk to accidents.

  4. POLICIES PROTECTING IRREGULAR IMMIGRANTS • In view of this there are policies protecting their rights: • Irregular migrants who have fled persecution or violations of their human rights must have an opportunity to claim asylum. • The must have protection which recognizes: • Right to life

  5. POLICIES….contd. • Right not to be subjected to torture or inhumane or degrading treatment • conditions of detention need to be regulated. • During detention they must have the right to emergency medical care as required by their state of health.

  6. POLICIES….contd. • Irregular migrants should be entitled to the protection of their property. • They should be able to manage or dispose of it. • Adequate housing and shelter should be provided to irregular immigrants.

  7. POLICIES….contd • Children of irregular migrants are particularly vulnerable should be entitled to social protection such as : • The right of basic material needs : • food • clothing • shelter • basic medical care.

  8. POLICIES….contd • Protection and assistance should be given to irregular migrants through: • Rehabilitation programs that will empower them for effective integration into their various communities. • Temporary accommodation and reception upon arrival in their countries.

  9. POLICIES….contd • Collective expulsions of irregular immigrants should be prohibited. • Measures should be taken to promote voluntary return as an alternative to forced return. • Escorts should be properly trained . • Human rights violations , should not be committed by state authorities.

  10. POLICIES….contd • Counseling and information , should be in a language they can understand.

  11. SITUATION IN DEVELOPING COUNTRIES • Unfortunately in many developing countries including Kenya there are no measures put in place to protect irregular immigrants with the exception of Nigeria who have national Policy on protection and assistance .
