Concerns about verbiage in 7.a- old language • “each testing certificate issued by the holder of this approval must be prepared in accordance with § 107.404 and include the identification symbol provided in Paragraph 5.a. The identification symbol is to be followed by a unique number for each package manufactured (four-digit minimum) which will refer to the specific packaging being certified as set forth in §§ (add specific subpart), as applicable. As an example, the first certificate issued would be marked “IM-XXXX” -####, where XXXX is the

  5. Concerns about verbiage in 7.a- old language • Is the approval holder’s identification symbol. Package serial numbers can be listed separately or sequentially.

DAA Approval letter Revision: section 7.a –revised language • Each “approval certificate” issued by the holder of this approval must contain the name and identification code of the approval agency (as provided in paragraph 5.a), along with any information required by 49 CFR § 178.255-14 and 178.255-15.

  7. CFR site supporting revised language • § 107.404(a)(2)- each approval certificate or certification issued MUST have name and identification code; (approval certificate replaces testing certificate). • § 107.403(a)(3) – acceptable format by the AA

CFR site supporting revised language • For the DAA involved in certifying UN portable tanks during manufacture; upon successful completion of all the requirements of subpart H, must issue an approval certificate. The certificate must include all the information required to be displayed on the metal identification plate required by § 178.274(i)

  9. CFR site supporting revised language • inspection and test markings (§180.605(k))- ….durably and legibly marked, in English, with the date (month and year), last pressure test, the identification markings of the approval agency witnessing the tests.

  10. DAA Approval letter: section 5.g • This is meant to prevent “conflict of interest” or the appearance of impropriety, where an approval agency with the ability to repair tanks, is not allowed to certify repairs it has performed.

Semi-Annual Reporting • Section 7 – Special Provisions: • 7 c – “The DAA shall submit a semi-annual report summarizing its previous year’s activities, the report shall cover 1 January to 31 June and July 1 and December 31 of each reporting year. The aforementioned report must be received by PHMSA’s Approvals and Permits Division, submitted in accordance with 49 CFR 107.705, within 30 days after the end of the reporting period. PHMSA can terminate the DAA current approval if such report is not received within this time limit.”
