The 1st Amendment has two clauses that specifically mention religious freedom: The No-Establishment Clause: “Congress shall make no law respecting the establishment of religion…” Congress cannot ever establish a national religion) Free Exercise Clause: “…or prohibiting the free exercise thereof…” (Congress may not prevent someone from exercising their religion)

  3. What happens if someone were to break the law in the name of religious freedom? Sherbert-Yoder Test ~ used to determine if an illegal act falls under freedom of religion Shebert-Yoder Test has two questions: Is this person really a member of the religion they claim to be in? Is this act really necessary?
