  2. Presentation Outline • Revision “2012” is slated to take effect on September 17, 2012. Highlights of this Rule Revision are: • The numerical chapter designation “1200-01-11” is being repealed and replaced with “0400-12-01”. This is a change from the current Tennessee Department of Health numbering system to the Tennessee Department of Environment and Conservation (TDEC) numbering system. • Adoption of the December 31, 2008, federal revisions that established a new Subpart K within 40 CFR Part 262. This revision establishes a voluntary alternate set of generator requirements applicable to laboratories owned by eligible academic entities. • Adoption of the July 7, 2010, federal rule package incorporating recent changes to the agreements concerning the transboundary movement of hazardous waste among countries belonging to the Organization for Economic Cooperation and Development (OECD).

Presentation Outline - Continued • Revised Definition of Solid Waste • This rule is expected to be revised by EPA this year. • The State of Tennessee has not yet adopted this rule due to concerns over litigation and possible revisions. • The State of Tennessee supports the 2008 version of the rule, provided improved safeguards are added for transportation on the public roads and off-site recycling of materials. • The State of Tennessee believes the July 22, 2011 proposed rule was inappropriate in expanding more regulation of on-site recycling or recycling exclusions that have existed for nearly three decades.

Presentation Outline - Continued • Revision “2013a” is currently under development and a public hearing is scheduled for September 26th. • This rule solely pertains to federal revisions and the correction of typographical errors. • The rule incorporates the federal removal of saccharin and its salts from the list of hazardous waste. • The rule also incorporates the revisions for the treatment standards for carbamate wastes and correction of the voluntary academic laboratory standards.

  5. Presentation Outline - Continued • Revision “2013b” is currently under development and is at the draft stage. • This is a packet of minor state initiated requirements. • We intend to add personal clothing leather good items to the list of excluded chrome waste. • Adding in some clarifying notes to assist the public in referring to related requirements or to alert them to related requirements. • Revising a few sections to read more clearly.
