  2. What is Profepa? The Office of the Federal Attorney for Environmental Protection (Profepa) is an autonomous agency under Semarnat • Functions: Enforcing the environmental rules under its jurisdiction. • Implements administrative inspection and oversight procedures. • Organizational structure: • Industry Inspection Bureau • Natural Resources Bureau • Environmental Audit Bureau • Legal Bureau • 32 federal delegations (state offices)

  3. Industry Inspection Bureau • Powers: • To ensure compliance with the legal provisions (laws, regulations and standards), prevention and control measures, mitigation, restoration and compensation measures under the rulings, authorizations, permits and licenses with respect to air pollution. • To verify that the sampling procedures are carried out according to the specifications established in the Mexican Official Standards (NOMs) for proper monitoring of air pollutant releases. • To provide technical support to the state delegations and the General Pollution Inspection Bureau during inspection proceedings, in the evaluation of air pollutant releases. • To approve accredited testing laboratories from a technical standpoint.

  4. Compliance with emissions standards under NOM-040 and 098-SEMARNAT • Profepa actions: • As part of its inspection procedures, Profepa has identified 84 sources relating to the cement industry and 74 hazardous waste heat treatment facilities, undertaking administrative proceedings at each. • The cement industry has undergone 106 inspection visits since 2001; approximately 50% of these visits found no irregularities and 50% found slight irregularities. • Hazardous waste heat treatment facilities have seen 171 inspection visits since 2001; approximately 40% of these visits found no irregularities and 60% found slight irregularities.

  5. Sampling of Air Pollutants • The Industry Inspection Bureau has appropriate equipment and highly trained personnel to sample air releases for the following pollutants: • Total suspended particles • Nitrous oxides • Sulfur dioxide • Combustion gases

  7. Verification of Sampling Train Calibration • Recognition of emitter and type of process. • Equipment must be calibrated every six months.

During sampling Oversight of Sampling Techniques • Preliminary sampling is done; data are used to calculate the nozzle diameter, isokinetics and moisture. • Two final samplings verify: • Nozzles not worn. • Starting filter condition. • Infiltration test done at start of testing. • Pressure properly adjusted at orifice plate at each point. • Reading taken from volume meter. • Port changes. • Infiltration tested upon completion of each sampling. • Combustion gas readings at start, middle and end of sampling. • Calculation of isokinetic rate.

Approval of Testing Laboratories APPROVAL PROCEDURE • Registration. • Performance evaluation. • Final report. • Follow-up, oversight and renewal of approval. • LIST OF APPROVED TESTING LABORATORIES • The are 25 laboratories approved to test stationary sources. NOM-040-SEMARNAT-2002 Definitions: Conventional fuel – fossil fuels Formulated fuel – product of a controlled mixture of residual liquids or solids, including hazardous waste, manufactured by a company authorized by Semarnat. Excludes pesticides, dioxins and polychlorinated dibenzofurans, radioactive waste, infectious waste, cyanides and organochlorides. Recoverable fuel - materials or waste (heat potential above 15 MJ/Kg), used oils, oil-impregnated textiles, new and used tires, and other wastes classified as nonhazardous.

NOM-098-SEMARNAT-2002 Field of application: This mandatory standard applies throughout Mexico, excluding Mexican territorial waters, for all facilities intended for use in waste incineration, other than crematoriums and industrial furnaces. Not applicable for the incineration of radioactive waste.

  17. NOM-098-SEMARNAT-2002 Specifications: • Submit testing protocol to Semarnat. • Have operator qualified to operate incinerator. • Have data recording system: logs, electronic files. • Logs must have numbered pages and be kept for five years. • Hazardous waste containing persistent organic pollutants and bioaccumulative compounds cannot be incinerated: organochlorine pesticides, batteries containing toxic metals.

NOM-098-SEMARNAT-2002 Environmental releases: • Maximum temperature of gases before emissions control equipment must be less than 250 °C when dry washers are used. • Frequency of measurement under Table 1 applies at all times other than startup periods or equipment downtime. • In the case of continuous measurement equipment malfunction, at least one measurement per day must be taken until the misadjustment is corrected. Semarnat must be notified immediately of failure and time to remedy. If daily measurement cannot be taken, waste feed into the incinerator must be halted.

NOM-098-SEMARNAT-2002 Environmental releases: • The incineration facility is exempt from analysis of certain table parameters when it is shown and sworn to Semarnat that the waste characteristics do not generate or concentrate the respective pollutants. Exemptions may be authorized for periods of no more than two years, provided that the results from three consecutive years of measurement of the exempt parameters are 25% below maximum allowable limits. • This provision does not apply to combustion quality parameters (CO and NOx).
