  1. TIP OF THE WEEK - April 21, 2014 Is there any situation in which OWCP will address the suitability of a temporary job offer? Temporary Job Offer Can suitability be addressed?

ANSWER: • The only time a temporary job can be reviewed for suitability and 8106c sanctions is when: • the claimant was a temporary employee at the time of injury AND • the job will last at least 90 days • In a decision issued on January 2, 2014, the Board held that OWCP properly determined that appellant had no LWEC(job was both medical and vocationally suitable) even though the job was temporary in nature. (13 ECAB 581, 2014) • The job was consistent with the appellant’s date-of-injury job • He successfully performed the position for at least 60 days (in this case 4 months). • and the wages appellant earned met or exceeded the current wages of his date-of-injury job.
