  2. What is a Hate Crime? A criminal offence committed against a person or property which is motivated by hate/bias or prejudice based on race, national or ethnic origin, language, colour, religion, sex, age, mental or physical disability, sexual orientation or any other similar factor.

Criminal Offences • 318 (1) Advocating or promoting genocide • with intent to destroy in whole or in part any identifiable group, • (a) killing members of the group; or • (b) deliberately inflicting on the group conditions of life calculated to bring about its physical destruction. (Maximum 5 years)

  4. Criminal Offences 319 (1) Public incitement of hatred Every one who, by communicating statements in any public place, incites hatred against any identifiable group where such incitement is likely to lead to a breach of the peace. (Maximum 2 years)

Consideration at Sentencing (FOR ALL CRIMINAL OFFENCES) • 718.2 (a) a sentence should be increased where there is: • (i) evidence that the offence was motivated by bias, prejudice or hate based on race, national or ethnic origin, language, colour, religion, sex, age, mental or physical disability, sexual orientation, or any other similar factor,

  7. Local Hate Crime Rates 2009 – 15 reported crimes (Rank #3) 2010 – 15 reported crimes (Rank #4) 2011 – 22 reported crimes (Rank #1) (2012 – 19 crimes / 2013 – 12 crimes) (Rank based on # of incidents per 100,000 population)

  8. Hate Bias Non-Offences Non criminal offences motivated by hate bias are also tracked 2009 – 5 2010 – 16 2011 – 18 2012 – 16 2013 - 5 (Trouble with youth/Neighbour disputes/Cause disturbance)
