Status Increased communication & coordination are achieving results: • FAA has participated in European Airworthiness Working Group deliberations on transfer of products • FAA/JAA/Commission deliberations on maintenance transition • FAA/Commission are discussing concepts for interim and final bilateral agreements

  3. Status Some Challenges Remain: • Many critical decisions that will impact EASA’s operations are still pending • EASA procedures, training, standardization methods must be developed • Absence of information on “Day-to-Day” issues continues to create anxiety for industry

  4. Common Transition Principles • Clear responsibility for continued operational safety. • Uninterrupted flow of products and services. • Transparency in the development of essential requirements, implementing rules, specifications, etc.

  5. Pre-Transition Work AirworthinessApprovals • Inventory of TCs (underway) • Inventory of appliance approvals and STCs (??) • Inventory of existing special arrangements/joint venture programs between U.S. and bilateral partners (FAA completed)

  6. Pre-Transition Work Maintenance Transition • FAA/Commission/JAA/NAA group have agreed to maintenance assessment plan • FAA assessments of NAAs underway, on the basis that AMO approval process will not change significantly • FAA review of draft EASA implementing rules and guidance materials has begun

  7. Pre-Transition Work FAA Actions • Documented TC transfer status for all European products that have been imported to the U.S. • Preparing order for AIR work force and designees to identify how to handle import/exports based on the FAA/EU transition matrix • Developing second interactive video training (IVT) to be delivered mid-September • Providing public website with Frequently Asked Questions about EASA

Pre-Transition Work EU Actions Needed • Implementing Rules and guidance materials need to be finalized • Functioning organization needs to be established • Single set of EU import requirements to ensure the elimination of additional national design requirements and facilitate product deliveries from October 2003. • Review of past ADs applicable as EASA ADs

  9. Pre-Transition Work EU Actions Needed • Decision on the process for monitoring continued airworthiness of products imported to Europe • Decision on EASA process for certification and surveillance of AMOs outside of EU • Information on lines of authority, outsourcing to Member State NAAs and qualified entities, etc.

  10. Other Challenges • Sustaining a viable enforcement system • EASA will rely on certificate action, but will not initially reissue certificates for approved products • Development and implementation of standardization/quality assurance processes • Clear division of responsibilities between NAAs and EASA for daily airworthiness release issues

  11. Bilateral Relationship • FAA assessment of technical competence for each area of regulatory responsibility and oversight • Evaluations of NAA oversight of AMOs underway • Process for evaluation of EASA HQ functions (e.g., type design, standardization, outsourcing) under discussion with Commission • Reliance on existing bilateral agreements until an agreement and relevant annexes with the European Community are in force

Bilateral Relationship FAA proposed an interim agreement to ensure a strong safety partnership and provide for : • Acceptance of existing bilateral agreements and their limitations during transition; • Continued mutual emphasis on operational safety • Acceptance of prior product approvals, existing delegation systems, etc.; • Continued recognition of existing JAR145 repair stations approvals; and, • Continued harmonization and regulatory cooperation
