  1. DECO/IMPEL PROJECT Project on Decontamination and Monitoring Procedures of Groundwater and Soils in Polluted ex-Industrial Sites Dominique Darmendrail (Common Forum) - Fabio Carella (ARPA Lombardia) Malta, 1st / 4th, October 2013 Conference on Implementation and Enforcement of Environmental legislation

  2. The 2006 EU Strategy on Soil Protection • Soilispractically a non-renewablenaturalresource • Soilperforms crucial functions for humanactivities and ecosystemssurvival • Costs of soildegradation are very high and are mainly borne by society and not by the land users • Soils are increasinglydegrading or irreversiblylost accros the EU • There is a need for a comprehensiveapproach Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  3. Different threats to address Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  4. Situation in European Member States / CF Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  5. THE DECO PROJECT CONTEXT • Remediation of contaminated sites is a strategic issue in the whole Europe (because the polluted areas compromise the possibility of a good land planning) • No European dedicated legislation or guidelines governing the issue of soil, subsoil and groundwater contamination. Member State adopted national rules • For this reason there is a need of good practices exchange among environmental authorities in Europe (in order to solve practical problems connected to technical, financial, as well as organizational issues) Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  6. Ground Water Directive Water Framework Directive DRAFT Soil Framework Directive Environmental Liability Directive Contaminated Sites Strategy Urban Environments Structural Funds IPPC / IED Directives Regulatory environment at European level NATURA 2000/ HABITATS Directives REACH? Waste Framework Directive Guidelines For State-aid Roadmap on Resources Efficiency INSPIRE Renewable Energies Directive Landfill Directive Strategy on waste prevention and recycling Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  7. AIMS OF DECO PROJECT • Identify good practices for soil and groundwater sites decontamination and monitoring • Identifypotocolsfor the remediation of ex-industrial areas At local, regional and national level in IMPEL member countries • Compare the approaches and best practices in order to evaluate their application in different technical-operational and regulatory-procedural contexts Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  8. DECO: SOME COMMON CRITICAL ISSUES • Determining who should pay and how to finance a decontamination action • The risk analysis procedure is widely used in Europe to determine the acceptable level of substances into a specific area, but it is quite a complex instrument • Legislation on reclamation is complex and the interactions with EU and national regulations on waste and water are not clearly defined. • Procedures are very long and complex: not only in terms of long time and high costs, but also for uncertain forecast Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  9. DECO QUESTIONNAIRE – FIRST PART • Regulatory Issues • Financial Issues • Start of the Remediation Process • Risk Management Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  10. DECO: QUESTIONNAIRE – SECOND PART • Preliminary Actions • Investigation of Environmental Compartments • Generic Assessment of Risks • Site Specific Risk Analysis • Remediation Work, Control of the Remediation Work Performed and Final Assessment • Management of the site after remediation Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  11. DECO PARTICIPANTS: National and Local Authorities • AUSTRIA – HaraldKasamas • BELGIUM – Jean-Pierre Janssens • FRANCE – Jean-Luc Perrin – Tina Leger • ITALY – Alessandra Negriolli – Fabio Carella – Beatrice Melillo – Rocco Racciatti • POLAND – Wojciech Barczewski • PORTUGAL – ÁlvaroBarroqueiro • SPAIN – Monica Medina Perez • CZECH REPUBLIC – Daniel Gruza • GERMANY – Birgit Harpke • LITHUANIA – Radiene Rasa – KadunasKestutis • THE NETHERLANDS – Anton Roeloffzen Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  12. DECO: PROJECT STEPS STEP1 Discussion on the first part of the Format – (i) General aspects and management, legislation. (ii)Starting of the procedures and activation of the first investigations. (iii) Risk management. (iv) Funding – each issue was analyzed and processed in relation to the answers received by the Member States participating to the Project First meeting Paris 3rd and 4th of June 2013 STEP2 Discussion on the second part of the Format – (i) Preliminary Actions. (ii) Investigation of Environmental Compartments. (iii) Generic Assessment of Risks. (iv) Site Specific Risk Analysis. (v) Remediation Work, Control of the Remediation Work Performed and Final Assessment, (vi) Management of the site after remediation. – each issue will be analyzed and processed in relation to the answers received by the Member States participating to the Project Second meeting Milan 24th and 25th of October 2013 STEP3 Report gathering all the information exchanged among IMPEL Member States on the implementation of different procedures aimed to the decontamination of groundwater and soils in polluted ex-industrial sites. If possible, publication of good practices examples, with highlighted management methodologies and possible suggestions, for the EU institutions and for IMPEL Member States. Conclusions Due June 2014 Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  13. DECO Paris Meeting , 3° and 4° of June - Participants • Austria– Harald Kasamas • Belgium– Jean-Pierre Janssens • France– Dominique Darmendrail • France– Jean-Luc Perrin • France – Tina Léger • Italy– Fabio Carella • Italy– Beatrice Melillo • Italy– Alessandra Negriolli • Italy– Rocco Racciatti • Italy – Maria Debora Di Matteo • Poland – Wojciech Barczewski • Portugal – ÁlvaroBarroqueiro • Spain– Monica Perez Medina Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  14. DECO Paris Meeting - Most Relevant Outcomes Chapter 1 - Regulatory Framework • The rule of “polluter pays" is not easy to apply because the polluter is not always detectable (especially for the historical contaminations) and the payer is not always clearly definable. • The principle is easier to apply in new contaminations. It is applied in all EU countries. • Interesting to see how this issue is addressed at European level: different mechanisms and tools to apply the “polluter pays” principle. • Need for connecting /integrating Contaminated site remediation legislation and other EU directives (Industrial Emissions – IED, Environmental Liability – ELD, Waste framework) and land planning. • Criteria to identify Potentially Contaminated Site and Contaminated Site: pollutant concentration criteria (limit values) vs. different criteria (kind of pollutant, industrial activity; geological criteria; intended use of the site; risk to human health and the environment; ..) Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  15. DECO Paris Meeting - Most Relevant Outcomes Chapter 2 - Start of the remediation process • Different “List” of facts and events to start a remediation process: accidents; land sales; site transfer, extension or closure of polluting / industrial activities; bankruptcy; expropriation; inspections and environmental monitoring; • Chain of liability: • polluter < land owner or land leaser < another person interested on the site < State (or Public Authorities) for «orphan» sites • Public action: difficult to finance the remediation Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  16. DECO: Paris Meeting - Most Relevant Outcomes Chapter 3 – Risk Management • “List” of risk management measures: emergency safety measures; identify and remove the sources of pollution; cut pathways of pollution; restrictions of the uses of the site; remediation ; permanent safety measures; operational safety measures for operational sites (remediation at the end of the activities) • No hierarchy between remediation measures/ actions, but check the efficiency of measures and techniques adopted or planned (modeling vs. measuring; short term solutions vs. long – term; source reduction/elimination vs. containment/monitoring ….) • Cost – benefits analysis between different measures and techniques Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  17. DECO: Paris Meeting - Most Relevant Outcomes Chapter 4 – Financial Issues • Different financial instruments: central budget, taxes, incentives, orphan sites remediation funds, targeted programmes, public–private partnerships, public–public partnerships, financial guarantees, foundations, etc. • Public funds for orphan sites according to different agreements/programs: national or European funds, • Different level of actions (federal/national, regional). Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation

  18. ICCL - International Committee on Contaminated Land Common Forum Networks • Network of contaminated land policy experts and advisors dealing with contaminated land management: • International scale (since 1993), Europe (since 1994) • Mission: • Being a platform for exchange of knowledge and experiences, for initiating and following-up of international projects among members • Establishing a discussion platform on policy, research, technical and managerial concepts of contaminated land • More information on www.commonforum.eu Malta, 1st / 4th, October 2013 – Dominique Darmendrail/Fabio Carella Conference on Implementation and Enforcement of Environmental legislation
