Sources of Jurisprudence Comparison القياس • Definition: • مساواة الفرع للأصل في علة حكمه • أركانه: الفرع، والأصل، والعلة، والحكم. • Extrapolating a ruling on a new issue(branch) after a comparison with an original ruling (origin), because of mutual link in the reason behind the original ruling. http://islamicleague.wordpress.com

  46. Sources of Jurisprudence Comparison القياس • مساواة الفرع للأصل في علة حكمه • أركانه: الفرع، والأصل، والعلة، والحكم. (الحشيش كالخمر في الحرمة للإسكار). فالحشيش فرع لأنه يقاس على شيء آخر ويلحق به. وكالخمر: هو الأصل، لأنه المقيس عليه. وفي الحرمة: هوالحكم، لأنه الوصف الشرعي المنقول من الأصل إلى الفرع. والإسكار: هو العلة التي من أجلها شرع الحكم في الأصل، وبسبب وجودها في الفرع مساوية للأصل نقل الحكم من الأصل إلى الفرع. http://islamicleague.wordpress.com

Sources of Jurisprudence Comparison القياس • Validity: • Quran قوله تعالى: (فَاعْتَبِرُوا يَا أُولِي الأَبْصَارِ) (الحشر:2) • Sunnah • حديث معاذ بن جبل ، حيث روي عنه أنه بعثه النبي إلى اليمن وقال له: بم تقضي؟ قال بما في كتاب الله، قال: فإن لم تجد في كتاب الله تعالي؟ قال: أقضي بما قضى به رسول الله ، قال: فإن لم تجد فيما قضي به رسول الله قال: أجتهد برأيي، قال : الحمد لله الذي وفق رسول رسوله لما يرضى به رسوله • Sahaba • ما روي عن عمر بن الخطاب بعد ما أرسل أبا موسى الأشعري والياً على البصرة، وكتب إليه كتابا : (اعرف الأشباه والأمثال وقس الأمور برأيك) http://islamicleague.wordpress.com

Sources of Jurisprudence Sahaba’s Rulings قول الصحابي • Definition: • الصحابي عند الأصوليين: هو من لقي النبي (ص) مؤمنا به ولازمه مدة طويلة بحيث يجوز إطلاق لفظ الصاحب عليه عرفا ولغة • (أصحابي كالنجوم بأيهم اقتديتم اهتديتم) • Companion: Who met the Prophet PBUH, believing in him, and stayed with him enough time learning and keeping company with him, so it is acceptable by social customs and language to call him a “companion” http://islamicleague.wordpress.com

Sources of Jurisprudence Preference الإستحسان • Definition: • هو ترك القياس الظاهر لدليل اقتضى هذا الترك. • عن عبد الله بن مسعود (ما رآه المسلمون حسنا فهو عند الله حسن) • Preference: to leave the ruling of Comparison for a better reason. • Accepted by Abu Hanifah.
