  4. Senate Bill 360 2005 growth management legislation • Requires annual update of the Capital Improvements Element (CIE) • Requires the Capital Improvements Schedule to be financially feasible • Applies to concurrency-related facilities only

  5. Senate Bill 360 Financial feasibility • Projects in fiscal years 1 through 3 are funded through a committed funding source • Projects in fiscal years 4 and 5 may be funded by committed or planned sources • Must demonstrate ability to achieve and maintain adopted level of service (LOS) standards

  6. Senate Bill 360 Additional requirements • A 10-Year Facilities Work Plan is required for the Urban Service Area • Alternative water supply projects must be identified • Must identify any deficiencies and strategies to address deficiencies

  7. Senate Bill 360 Annual updates • CIE updates must be adopted by December 1 of each year • If the CIE is not adopted • County cannot adopt any Future Land Use Map amendments • Sanctions may be imposed on the County

  8. Senate Bill 360 2009 growth management legislation • Annual CIE update does not need to comply with financial feasibility requirement until December 1, 2011 • Penalty for not adopting annual CIE update is not effective until December 2011

CIE Update Policy amendments CIE1.1.13 (identified in staff report and Ordinance as CIE1.3.13) Updates the date of the most recent Orange County School Board District Facilities Work Plan CIE1.3.16 and PS6.1.3 Removes the separate K-8 adopted LOS and incorporates it in the LOS for elementary and middle schools

  11. CIE Update Policy amendments CIE1.3.18 Revises the list of backlogged facilities and identifies existing and 5-year school LOS as well as 10-year LOS

CIE Update Policy amendments CIE1.8.1 Deletes Apopka Vineland Road (from AD Mims Road to Clarcona Road) from the LTCMS Transportation Schedule CIE1.8.4 Adds Conroy Windermere (from Lake Street to Dr. Phillips Boulevard) to the list of roadways considered constrained based upon location within a jurisdiction, existing development, ROW limitations and hydrological features

Action Requested Make a finding of consistency with the Comprehensive Plan and adopt Amendment 2010-1-B-CIE-1, which includes amendments to the Capital Improvements and Public School Facilities elements, including corrections noted Adopt Ordinance 2010-03, including corrections noted Adopt the first amendment to the Interlocal Agreement for Public School Facility Planning and Implementation of Concurrency
