  1. FSSAI issues an Order Permitting Rectifying of Labelling Information for Imported Food Consignments

On 18th November 2022, the Food Safety and Standards Authority of India (FSSAI), which is the Statutory Authority established under the Food Safety and Standards Act, 2006, issued an Order in regard to Rectifying Labelling Information for Imported Food Consignments. The Order states that for the purpose of facilitating ease of trade while also ensuring the safety of the food being imported into India is being maintained, in accordance with Regulation 6 (4) of the Food Safety and Standards (Import) Regulations, 2017, FSSAI has decided that all non-compliant labels on imported food consignment are henceforth permitted for rectification at the port itself. Regulation 6 (4) of the Food Safety and Standards (Import) Regulations, 2017 states the mandated labelling requirements, which are as follows - Name and address of the importer Food Safety and Standards Authority of India’s Logo and license number Non-Veg or Veg Logo Category or sub-category, along with the generic name, nature and composition for proprietary food The Order further states that the rectification of the labelling information is required to be carried out at Customs bound warehouses prior to any visual inspection or re-inspection by the Authorised Officer and their representatives by affixing a single non-detachable sticker or through any other non- detachable method. The authorised officer and their representatives are required to verify the label compliance during the visual inspection, and the consignment is subject to sampling and testing only if the packaged commodity is compliant with the labelling requirements in accordance with the Food Safety and Standards (Import) Regulations, 2017.
