Accessibility, affordability and speedy justice are the fundamental requirements of a good judicial administration. The concept of docket explosion is a sign which signifies that the Indian citizenry reposes faith in the judicial system of the country and are approaching the courts in their quest for justice. It is only those cases which are not disposed of within the stipulated period of time or within their case life, that ultimately turn into an arrear.Mounting arrears of cases in the courts have been a cause of great concern for the litigants as well as the State. This is attributed mainly to the lower rate of disposal of cases in comparison to the number of cases instituted. In the present times, there has been an upsurge in the pendency of litigation in the country, especially in the district courts. Justice, as promised by the Constitution of India, will not be realised until and unless the justice delivery system is made within the reach of the individual in a time-bound manner and within a reasonable cost. Article 21 of the Constitution of India guarantees the right to speedy trial as a part of right to life and liberty. Therefore, delay in disposal of cases may in a way result in denial of this fundamental right. Numerous attempts have been made from time to time to address the challenges of judicial pendency and delay but still the matter has not been resolved in its entirety. The Law Commission Reports and various independent studies have also flagged the issue and suggested various reforms. It may be worth noting that technological advancements are useful and may be effectively used in the justice administration. With the integration of technology to court proceedings, an end to case pendency problem may finally be in sight and within reach!
