  2. Terminology & Definitions • Asylum Seekers – applying, failed, ELR • Refugees – ELR, ILR or integrated • Not economic or other migrants • Not from EU countries – issues re Accession Countries – uncertain about Northern Cyprus

  3. The Law • Many British people are descended from refugees • UK Law recognises the need to grant refuge or asylum to people fleeing persecution, war or disaster • The law makes clear distinctions between Refuge/Asylum and Migration. Seeking Asylum must be for humanitarian reasons and not a route to migration

  4. The Law (cont) • The aim of various Asylum Acts and policies is to ensure that those who need asylum get it • Key acts - Asylum & Immigration Acts; Human Rights Act; Children Act; Disability Discrimination Act; Race Relations Act

  5. Recent Changes • Entry without passport/papers • Trafficking • Credibility • Responsibility towards destitute “failed applicants” Children yes! Others? • Hard case accommodation scheme dependant on community activities • Unified Application System • National Strategy for Integration

  6. Different Levels of Support due to: • When people arrived • Where they arrived • How they claimed • Ages of people in the group • Stage of application/appeal • Disability or specific need All these affect who supports the applicant

  7. Responsibilities affecting local authorities • The Education and Welfare of Children • Varying responsibilities for Adult, Further & Higher Education • Refugees, ILRs & ELRs can work – Seekers cannot take PAID employment * • Health – some impact • Housing for Asylum Seekers: Dispersal, Induction Centres, Emergency Accommodation • Refugees, ILRs & ELRs may join local authority housing lists

Responsibilities affecting Local Authorities (cont) • Integration – ensuring that people get correct support as their status changes • Voting – only for Refugees, ILRs/ELRs granted British citizenship or who are already commonwealth citizens • Citizenship entitlement • Protection from Racial Harassment • Duty to promote good relations between different racial groups • Uncertainties about powers to support AS already supported before the NASS existed
