Need to use Section 408 • DWR FloodSAFE Early Implementation Projects (EIP) in advance of the Central Valley Flood Protection Plan • proposals to alter physical features of federal flood damage reduction project • USACE determined need to process, review and approve pursuant to 33 Code of Federal Regulations, Section 408 (33 CFR 408) • projects are not encroachments • Board’s California Code of Regulations, Title 23, Division 1 (CCR 23) were used without revision to process 408 requests to USACE and issue permits for construction • Board recognizes need to develop new 408 process-specific regulations for addition to CCR 23
