Board Approvals Prior to 408 • Encroachment Permits pursuant to 208.10 • Borrow and excavation, irrigation and drainage, utilities, walls, fences, gates, boating facilities, roads and ramps, vegetation, bike trails, housing and structures, etc. • Board-sponsored projects • 10-15 year process by USACE • Engineering and environmental review by Division of Flood Management Flood Projects Office • Current examples • American River Common Features • Folsom Joint Federal Project • Marysville Ring Levee • Natomas and West Sacramento GRRs

Need to use Section 408 • DWR FloodSAFE Early Implementation Projects (EIP) in advance of the Central Valley Flood Protection Plan • proposals to alter physical features of federal flood damage reduction project • USACE determined need to process, review and approve pursuant to 33 Code of Federal Regulations, Section 408 (33 CFR 408) • projects are not encroachments • Board’s California Code of Regulations, Title 23, Division 1 (CCR 23) were used without revision to process 408 requests to USACE and issue permits for construction • Board recognizes need to develop new 408 process-specific regulations for addition to CCR 23
