State On The Legality Of Electronic Signatures State On The Legality Of Electronic Signatures In simple words an e-signature is a replica of a hand-written signature on any file, contract or document, which tells who has actually signed the document or who is the authorized party. Its a confirmation which states that the document is signed by an authorized person and can’t be tampered by any means. Did you know? Electronic signatures are legally binding in the U.S., U.K., Canada, Australia, New Zealand and many nations around the globe. Many electronic signatures have been upheld in numerous court cases and in many instances proved to be more effective than paper-based documents. This is because of the robust authentication data captured by the online signature software which provides evidence of who exactly signed the document and gives a precise description as to who, when, and how the signature was made. Certain e-signatures use cryptology which has public and private keys, and acts like a combination lock and can only work if both the elements are present. The major E-signatures laws include the following: 1. E-SIGN Act (U.S.): In this act using an electronic signature a file cannot be said to be ruled unenforceable if they are created electronically or digitally. 2. Electronic Communications Act (United Kingdom): This act is all about encryption services, providing guidance on storage, and electronic communications for whosoever incorporates an electronic signature. 3. PIPEDA (Canada): This act mentions how a business should handle any client data in order to ensure top-notch security and privacy. 4. UETA (U.S.): This act was specifically made for bringing consistency to varying state laws in regards to the online document execution & e-signatures. 5. Electronic Transactions Act (Australia): This act provides a regulatory frame work for electronic transactions and tells that no transaction will be invalidated if its electronic in nature.
