Someone asks me for the time, so I take out my cell phone just to peak at the time. One of the teachers notices that I have a cell phone in my hand and they confiscate it. Are they allowed to do that? I wasn’t even texting.
Yes, teachers are allowed to confiscate your cell phones if they are visible. No matter what you are doing with it, if it is visible, teachers are allowed to take it from you.
Ok, ok….so what if my cell phone is OFF in my pocket and I want to show my awesome new bejeweled cover? Are they still allowed to take it from me?
Survey says, YES! It doesn’t matter if its on or off, if we see it, we can confiscate it.

No. Your phone must be turned off when it is 7:40am -2:36pm. Therefore, the moment homeroom begins, your cell phone is fair game.
First offense, warning; student may retrieve the cell phone at the end of the day from the Dean of Students.
Second offense, Parents must come to school for a conference with the Dean of Students before the cell phone is returned.
Third offense, Cell phone is confiscated and returned to the parent at the end of the school year.

I wouldn’t do that if I were you. Cell phones and electronic devices work the same way and are considered the same thing.
