  2. MISSION STATEMENT • To protect and assure that all residents of the State of Utah have equal opportunity to access housing, by investigating and enforcing complaints of housing discrimination and by educating the public.

  3. APPLICABLE LAW • The Utah Fair Housing Act, as amended, U.C.A. 57-21-1, et. seq. • The Federal Fair Housing Act, as amended. 42 U.S.C. 3601, et seq.

  4. Race Color Religion Sex Familial Status (families with children under the age of 18) Source of Income (Utah) National Origin Disability PROTECTED CLASSES

  5. Prohibited Conduct In the following areas: • Financing • Selling • Renting a residential dwelling If race, color, sex, national origin, disability, religion, familial status, or source of income are used as a factor.

  6. Prohibited Conduct • Refusing to Rent or Sell Housing • Making Housing Unavailable • Setting different terms, conditions or privileges for sale or rental of a dwelling (For example, different deposit rates, restricting access to facilities, etc).

  7. Prohibited Conduct • Falsely denying housing is available. • Blockbusting (For profit, persuading owners to sell or rent). • Denying anyone access or membership in a facility or services.

  8. Prohibited Conduct • Advertising in a discriminatory manner • Making any type of verbal or written statement that indicates a discriminatory limitation or preference • Refusing to make a mortgage loan • Refusing to provide information regarding loans

  9. Prohibited Conduct • Imposing different terms and conditions for purchasing a loan • Discriminating in appraising real property • Refusing to purchase a loan

  10. Prohibited Conduct RETALIATION It is illegal to threaten, coerce, intimidate, or interfere with anyone or anyone assisting others in exercising their rights under the fair housing laws.

  11. Housing Covered Most type of housing is covered including housing that is privately owned. Exceptions: • Owner occupied - no more than four units • Single Family house sold or rented without a broker • Housing operated by organizations & private clubs that limits occupancy to members.
