Right to Have a Prompt Settlement Acknowledgment within 15 days Provide assistance and information to be provided in Proof of Claim Initiate necessary investigation DUTY to investigate promptly, fully and fairly. Provide response within 15 days Must be accepted or denied within 40 days Written notice if additional time required. Provided every 30 days Tender payment in 30 days if accepted.

Right to Have Fair Settlement Cannot discriminate upon race, gender, income, religion, language, sexual preference, ancestry, national origin, physical disability, or territory Disclose all benefits, coverage, and time limits Assist in determining more benefits upon proof Shall not require a Release before partial payment Fully explained in writing if not represented by attorney Cannot seek information not reasonably required

Right to Equitable Settlement Cannot “lowball” offers Evidence submitted to support value of claim Evidence reasonably available Procedures used by company in determining amount of damage Duty to hire competent, unbiased adjusters/contractors Inform of coverage under which payment has been made Provide basis of denial or offer of settlement Should not advise you not to hire an attorney
