  1. Fast Track Examination Get it quicker but just as good!

  2. Why? • In December 2005, the Chancellor of the Exchequer asked Andrew Gowers to review the UK’s Intellectual Property Framework. • One of the recommendations suggested that fast track processing, subject to the payment of a higher fee, should be pursued.

  3. Consultation & Rules • Consultation – The UKIPO consulted with stakeholders to establish how fast-track should operate. • The amendments necessary to the Trade Mark Rules 2000 and the Trade Marks (Fees) Rules 2000 to bring fast-track to fruition came into force 6 April 2008.

  4. Fast-Track Criteria • Can only be requested by filing electronically and selecting fast-track examination. • All fees must be paid, via the electronic application form, at the time of filing; payment may be made by debit or credit card or by deposit account. • Fast-track costs an additional £300. This is additional to the standard application fee of £200 and any classes fees (£50 per class). • Fast-track applications can only relate to a single trade mark and not a series of marks.

  5. What do you get for your money? • The application will be examined and the examination report sent by e-mail and by letter within 10 business days beginning on the first business day after the filing date of the application. • If the report is not issued within 10 business days the fast-track fee (but not the application or any class fees) will be refunded.

  6. What happens after? • If there are no objections then the application will proceed to publication in the Trade Marks Journal (for opposition purposes). If we do raise objections then correspondence follows in the normal way. • Although the fast-track relates only to the examination, we will, nevertheless, attempt to deal with all correspondence (and other procedural matters) as quickly as possible.

  9. Successful? • Following a successful launch, there has been a steady demand for the fast-track service with over 30 applications processed. • The 10 business day target has been met in all cases.
