  4. When and Where? • First organized in 1804 in France • Applied to European territories such as Spain, lower German states and North Italy • In England, Napoleonic code was never functional, they followed the Civil Law Germany France Spain North Italy

Napoleonic Code • Set of Laws that Napoleon Bonaparte created • Based off of the Roman Law • Revised many points to fit what he wanted Features: • Every person was equal before the law • No secret laws could exist • All laws had to be published • Religious crimes- illegal • Divorce treated as a civil manner • Granted men many rights

Examples of the Code Husband commits adultery and brings the woman into his home • wife may seek a divorce • the man would be granted the custody of his children unless otherwise ordered by the court • an example of superior male rights Woman commits adultery anywhere • husband may seek a divorce • man would be granted the custody of his children unless otherwise ordered by the court Husband does not like a material item that his wife possesses • legal authority to obtain item and do what he wants with it. (e.g. throw it away) Anyone caught practicing witchcraft, or religious crime • Court of law would decide fitting punishment for the individual • Was considered a serious crime • Punishments were often harsh

How it has Affected the Canadian Legal System • Affected laws in Quebec • Quebec is the province primarily affected by the Code • The Civil Code of Quebec is based off of laws found within the Napoleonic Code • Many of these laws are still being used today in Quebec • Quebec revised the laws that were in the Napoleonic Code • Made them suit the people of Quebec
