  2. Introductions • Who am I? • Mark Pollins, Director, Water Enforcement Division, Office of Civil Enforcement, US Environmental Protection Agency, Washington, DC • pollins.mark@epa.gov • And you?

  3. Week One • General Introduction and overview of the course and goals. (1/2 hour) • Intro to the US legal system and the Environmental Protection Agency and the Department of Justice.(1/2 hour) • Putting the pieces together-general survey. (2 hours) • Intensive session on the Clean Air Act. (First hour of 2.5 hour session)

  4. Week Two • Intensive session on the Clean Air Act (continued). (Remaining 1.5 hours) • Intensive session on the Resource Conservation and Recovery Act. (2 hours) • Intensive session on the Comprehensive Environmental Response, Compensation and Liability Act (Superfund). (First half hour of a 1.5 hour session)

  5. Week Three • Intensive session on the Comprehensive Environmental Response, Compensation and Liability Act (Superfund). (Remaining hour of a 1.5 hour session) • Intensive session on the Clean Water Act and Safe Drinking Water Act. (3 hours)

  6. Week Four • Achieving compliance with the regulatory programs: principles of environmental enforcement. (1 hour) • Compliance Monitoring and Inspections. (1 hour) • How targeting environmental problems and the causes of those problems operates in the US. (1 hour) • Civil administrative enforcement. (One half hour) • Overview of civil judicial enforcement. (One half hour)

  7. Week Five • Basics of criminal enforcement. (One half hour) • Factors in deciding whether to pursue criminal sanctions. (One half hour) • Choosing the Appropriate Enforcement Mechanism. (One half hour) • Elements of a settlement. (One half hour) • Penalties and economic factors. (2 hours).

  8. Week Six • Innovative compliance techniques: self audits and self policing policy. (1.5 hours) • Innovative compliance techniques: supplemental environmental projects. (1 hour) • Innovative compliance techniques: expedited settlement offers. (One half hour) • Concluding discussion. (One hour)

  9. Goals • A basic understanding of US Environmental Law. • A deeper understanding of how the law is practiced. • An appreciation for how the authority granted by the legislature may be used in innovative ways. • How some of the programs discussed may be applied in Ukraine.
