A filled divorce is a lawsuit. After a person files a divorce application against its spouse a back-and-forth legal process is initiated. A lot of factors has to be considered during these processes. Children custody and property distribution are the main aspects of a divorce. Initial filing of the divorce is called a “petition” or “complaint”. The next move is of the other spouse and the process continues in a series of step. For the sake of simplicity, we will assume that the petition is filled by the wife. Firstly the spouse against whom the petition is been filed must receive the notice of the divorce in a way that can be easily verified by the court. Every state has its own set of rule that constitutes the proper way. The spouse then gets a time frame of 30 days. In these 30 days, he is supposed to respond to his answer based on the petition. He should address all of the demands raised by its spouse and can either accept or reject them. He can even issue a counter demand. However, if he fails to reply within the next 30 days then the court will assume that he accepts the conditions set by his wife. After this, the process of discovery begins. Yet, uncontested divorces are rare as the anguish between both the spouses eliminates the possibility.
