  5. What Are the Legal Obligations of Educators? • Use Mitchel Yell’s article, Chpt 9 and the circular letters to determine the obligations educators have to protect students. • What is the district’s responsibility? • What is the school’s responsibility? • What is the teacher’s responsibility?

  6. District • Clear policies • Professional Development • Appropriate staffing • Guidelines for administrators and teachers • Clear procedures for suspension and expulsion • Clear guidelines of liability and responsibility of educators • Due Process –compelling State Interest

  7. School • Clear school-wide expectations • Clear discipline procedures • Office referral system • Safe and supervised settings for detentions, time-outs, or in-school suspensions • Adequate supervision and staffing

  8. Classroom Teacher • Clear expectations • Appropriate discipline procedures • Supervising student behavior at all times • Clear transference of student to other staff • Using prevention • Avoid touching or harsh verbalization • Clear documentation of incidents noting witnesses
