  3. What is “estate planning”? Making a plan in advance and naming whom you want to receive the things you own after you die.  What is “trust”? A fiduciary relationship regarding property and charging the person with title to the property with equitable duties to deal with it for another's benefit.

Why create an estate plan? • After Death • Control who receives your assets • Control when they receive your assets • Possibly reduce taxes and legal fees • Reduce stress for heirs and family members • Upon Disability • Control assets and identify agents • Control medical decisions and identify agents • Act without Court supervision

  6. Who needs planning and when? • Who (EVERYONE!) • Families with young children • Blended families • Non-traditional couples • Single adults (young or old) • When (NOW!) • Plan while you can • Plan before incapacity • Unfortunately, there comes a point when planning is too late.
