Why Revisions are Needed • Eliminate ambiguity and confusion in current rules about what tests are required • Ensure certified installers know and understand changes in regulations • 2008 UST secondary containment required by federal Energy Policy Act • Operator training rules currently under discussion to take effect in 2009 • Future changes contemplated

Requirements for Initial Certification (20.5.14.8, 9 & 10) • Application and fee ($50, no changes) • Experience requirements • Expanded in 20.5.14.12 to allow experience in other states • Must include inspection reports and contact information for work done in another jurisdiction • On-site examination ($300, no changes) • ICC national test on AST or UST installation • NM Laws and Rules Test (a new requirement)

  4. Requirements for Renewal (20.5.14.15) • Application and fee ($50, no changes) • Experience requirements • Expanded to allow experience in other states • Must include inspection reports and contact information for work done in another jurisdiction • NM Laws and Rules Test (a new requirement)

  5. NM Laws and Rules Test • Administered by the PSTB around the state at request of installer • 1 hour closed-book, objective test (multiple choice and true/false) • Cost: $45 (like old ICC test) • Updated annually • Separate for AST and UST installers • Must pass with 70% or higher

  6. NM Laws and Rules Test (2) • Covers major areas of rules involving general requirements of Petroleum Storage Tank Regulations, because: • Inspectors cannot supervise every installation, modification, repair, closure • Owners and operators ask installers for advice and quotes on work and rule requirements • Regulations are in process of change

  7. Clarification of Existing Requirements • Certified installers need not maintain ICC certification (no 2-year, 4-year confusion) • Deleted former language in 20.5.14.16.G • Change 4-year renewal cycle to March, rather than September • Matches current extension • Slower time for Petroleum Storage Tank Bureau

Clarification of Existing Requirements (2) • Clarified requirements concerning on-site exam (20.5.14.13 NMAC) • Former term “inappropriate materials” clarified as “use of materials or installation practices that violate these regulations, manufacturer’s installation instructions, or other industry standards.” • Stated requirement that PSTB staff fail an applicant who has 3 significant errors during an on-site exam

  9. New Administration and Tracking • Installer program will be administered by central office in Santa Fe • Reminder letters 2 months before renewal • More frequent testing options in more locations • Annual updating of test questions • Annual review of expiring certifications

  10. Goals • Make this process easier for installers • Ensure installers are up-to-date with current New Mexico regulations and requirements • Prevent releases and protect the environment
