The role of CA Dept of Ed and State Library General Information about E-rate • CDE/K-12 HSN & State Library: • Have no statutory authority to administer the federal E-rate program • May only offer general information about the E-rate program including: training and outreach, reference materials, and other publicly available SLD/USAC resources • The following information is provided to assist applicants with their applications. It remains each applicant’s responsibility to ensure FCC/USAC, State, and local agency rules and practices are followed. All liability and risk rests upon each applicant for E-rate approval.

  6. Key Terms • California Office of Technology Services (“Otech”) • CALNET 2 and CALNET 3 contracts • Master Service Agreement (“MSA”) • Authorization to Order (“ATO”) • State Replacement Contract (“SRC”) • Contractor, Service Provider, Vendor • E-rate applicant • Funding Request Number (“FRN”)

CALNET 2 extended through January 30, 2016 – HOWEVER, FCC does not see this as a valid extension for E-rate applicants CALNET 2 Expiration • State finalized extension of contract end date from January 29, 2014 to January 30, 2016 • MSAs 1 and 2 AT&T services (landline services and long distance) • MSAs 3 and 4 Verizon services (VoIP) • Purpose of extension is to facilitate transition of services to CALNET 3 • Extension only applies to existing services, and NEW services must be ordered off of CALNET 3

CALNET 2 extension does not have a viable use for E-rate purposes CALNET 2 Extension • FCC has indicated that a waiver for the contract extension will NOTbe allowed for CALNET 2 with the 2005 State Form 470 • Even if applicant filed its own Form 470 and checked the box for voluntary contract extensions when it awarded CALNET 2, FCC does not see validity of allowing for continued use of CALNET 2 contract for E-rate purposes • Reason has to do with language on RFP for CALNET 2 that only indicated extensions through January 30, 2014 and no further

  9. How does this affect applicants for FY 2013? CALNET 2 Extension • Applicants MUST transition to CALNET 3 as soon as possible if they used State Replacement Contract (“SRC”) process for FY 2013/14 applications • During the conversion/transition period starting January 30, 2014 though the effective date of CALNET 3 ATOs, USAC will treat services as month-to-month • The entire 2013 funding year will be covered • Working with USAC to define and facilitate this process – more information forthcoming

  10. How does this affect applicants for FY 2014? CALNET 2 Extension • CALNET 2 cannot be used for FY 2014 funding requests • Applicants can use CALNET 3 and 2013 State Form 470 for FY 2014 applications OR file their own Form 470 and conduct their own bidding processes • More information on using 2013 State Form 470 later in presentation

Award of Category 1 Voice and Data Services CALNET 3 Status • California Office of Technology Services (OTech) posted a State Form 470 and contracts were awarded November 15, 2013 • Six subcategories were awarded • Multiple awardees in some subcategories • Important information posted on State’s website regarding services, pricing and awards http://marketing.dts.ca.gov/calnet3/ • ALL PRICING IS NOW AVAILABLE ON THE STATE’S WEBSITE

Services Transition (see Grid on next slide) CALNET 2 to CALNET 3 • Certain services under CALNET 2 are transitioned to same provider (blue) • Certain services under CALNET 2 are now available from multiple providers (yellow) • Not all services available under CALNET 2 have been awarded yet under CALNET 3 (white) • The State posted an additional form 470 that could add to the available services (Broadband Services ) on the state master contract for E-rate purposes. However, this will be done outside the window, and will not be available for the current E-rate window FY 2014/15.

  13. Ordering Services under CALNET 3 CALNET 2 to CALNET 3 Transition • Identify services received under CALNET 2 • Review CALNET 2 ATOs and bills for service • Identify what services can be migrated to CALNET 3 now • For C2 services that have not yet been competitively bid by the State, you must follow the standard E-rate competitive bid process, e.g., issue a Form 470, construct a bid evaluation, etc. • Visit State’s website for service descriptions, pricing and ATOs: http://marketing.dts.ca.gov/calnet3/ • ID services that require an E-rate mini-bid and conduct mini-bid if necessary (discussed later) • Execute ATO(s) for service • An ATO must be signed by the applicant, service provider, and the State before it is valid

Multiple Contractors for Service E-rate Mini Bid Requirements • If using the State Form 470 or own Form 470, allowing only bids from CALNET 3 contractors, a mini-bid is required: • All contractors capable of providing service in subcategory must be compared – ONLY EXCEPTION is if contractor does not provide service in your area – verify and document • Price of E-rate eligible services must be given the highest possible weight in mini-bid evaluation process • Download pricing from State’s website or contact all contractors that can provide service for quotes (keep this info for your e-rate records)

Documentation of Process E-rate Mini Bid Document Requirements • Copy of bid evaluation matrix • Copies of vendor’s pricing schedules • Copies of quotes and vendor correspondence relating to mini-bid (if applicable) • For subcategory 1.6 (Legacy Telecommunications), copy of ATR Bulletin 13-04 showing only one possible provider http://www.dts.ca.gov/pdf/stnd/atrbulletins/2013/ATR13-04.pdf • Copies of executed ATOs • Board minutes if contracts are taken for Board approval

Conduct Mini-Bid and Execute ATOs E-rate FY 2013 Next Steps • For SRC FY 2013 funding requests, an E-rate compliant mini-bid is required for services in CALNET 3 subcategories 1.1, 1.2, 1.3 and 1.4 • Upon selecting service provider(s), sign ATOs and submit for processing as soon as possible • Effective date on ATOs must be on or after the date on the Mini-Bid evaluation matrix • More information coming soon on how USAC will process pending FY 2013 applications with SRC FRNs • SRC FRNs may be split into two or more funding requests depending on providers chosen

Converting to CALNET 3 E-rate FY 2014 Next Steps • Applicant may use State Form 470 and conduct a mini-bid if required (see grid on following slide) • If already doing a mini-bid for 2013, a second mini-bid is not required • ATOs MUST be executed PRIOR to filing of Form 471 and March 26 deadline by all three parties (applicant, provider, and state) • If executing ATOs for FY 2013, a second set of ATOs is not required • For services NOT covered under the State Form 470, applicant must file its own Form 470 and conduct its own bidding process

If using 2013 State Form 470 E-rate FY 2014 FRNInstructions • Form 470 number is 335470001069064 • Service Provider Identification Number (“SPIN”) – Contract the service provider • Contract Award Date = date that State signs ATO • Service Start Date = 07/01/2014 • Contract End Date = Date indicated on ATO

Important Deadlines • If you are on CALNET 2 now (& most public sector CA Education/Library applicants are), then YOU MUST DECIDE for upcoming funding year what you will do for all YOUR services on CALNET 2 contract • BY NO LATER THAN: • LAST DAY TO POST Form 470 (February 26, 2014)  • Form 471 application deadline is 8:59 PM March 26, 2014 • Or use State Form 470 and process ATO immediately (Review Services on Contract)

Future Form 470for State Master Contract • There is an additional Form 470(s) for State Master Contract posted AFTER the Window closes • This Form 470/services may not be available for the E-rate application window of 2014-2015, but will be available for the E-rate 2015-2016 E-rate application year

  24. Summary CALNET 2 extension through January 30, 2016 is not valid for E-rate Purposes. CALNET 2 expired on Jan 30th, 2014 for E-rate FY 2013 SRC FRNs must follow process as documented on Slide #14 FY 2014 must follow process as documented on Slide #20. Further clarification for E-rate applicants as information is available Action Items: CALNET 3 pricing for mini-bid and process for signing ATOs is now available, process ATO now after selection of provider K-12HSN/CDE is to work with USAC If in doubt, issue your own Form 470, follow E-rate competitive bidding processes, etc.
