  2. Syringe Law in California • Dispensing syringes without a prescription is a violation of Business & Professions code • Most states require no legislation in order to promote OTC pharmacy sale of syringes

  3. Senate Bill 1159 • Allows OTC sales in counties that authorize • Sunsets in 2010 • Opt-in oriented: counties and cities can opt-in, pharmacies can opt-in

  4. Purchase up to 10 syringes without a Rx if age 18 years Possess up to 10 syringes if acquired from an authorized source Carry syringes “containerized for safe disposal” and these syringes cannot be considered as illegal drug paraphernalia Individuals may:

  5. Pharmacies register with the county & give out info on: Drug treatment HIV and HCV Syringe disposal Pharmacies must provide some method of disposal Requirements

  8. Simple program, few requirements IDUs report “Never” sharing syringes at higher levels in counties with OTC sale Pharmacies reaching a different subpopulation of IDUs: Higher proportions of Latinos and Whites Higher proportions of amphetamine injectors What works well? 8
