BUDGET ALLOCATION ICD NORTH WEST • The allocation for the financial year 2004-2005 was R2051 000.00. • Personnel = R1493 000.00 • Operations = R558 472.00
Highlights Klerksdorp Investigation • Complaint The complainant alleged that he was traveling in the company of his wife and two children. He parked behind a white Corolla in Klerksdorp. As he passed the corolla a white woman asked rudely if he cannot park his car properly. Before he could respond, a white male appeared and asked what was going on. The white woman responded by saying “ Die Kaffir kan nie mooi parkeer”. He objected to being called kaffir. The white male bumped him with his car, he fall on the ground. While on the ground he was assaulted by this white male. He also assaulted his (complainant’s) wife and sprayed the family with pepper spray, after trying to lock them into the boot of his car.
b) Action by ICD The complainant Mr. Malefo complained to the ICD after he had already laid charges with the Police. The complainant and his wife were charged for malicious damage to property by the suspect. After our intervention we establish that the suspect was in fact a Snr. Supt. in the SAPS. We received the docket from SAPS and established that they had finalized investigation on the charges laid by complainant. But upon perusal of the docket we found that crucial evidence was still lacking in the docket. We liaised with the complainant and did witness canvassing, and we were able to obtain important evidence. As a result of our intervention cases against the complainant and his wife were withdrawn. The Director of Public Prosecution then decided to prosecute the Senior Police Officer and his wife. They are charged with two counts of Assault GBH, two counts of Assault, Reckless and Negligent Driving, Use of Motor without owners consent, and Pointing of Fire- arm. The Case has been postponed to 04 May 2005 for trial.
Batlharos Investigation • Complaint The member was arrested for assaulting his girlfriend. He requested to speak to his girlfriend, he was allowed to speak to his girlfriend without supervision. He went outside the Police Station building with victim. Members in the Station heard two shot being fired, they went out to investigate and found that the member has shot his girlfriend. She died on the scene. b) Action by ICD The ICD attend the scene of the Crime after being called by the Police. All the necessary evidence was obtained, the suspect appeared before court and bail was successfully opposed. On the 15 June 2004 the accused was found guilty of murder at Mafikeng High court and sentenced to 25 Years imprisonment.
STATION AUDIT • Stations are visited to inspect detention facilities, to inspect compliance with Domestic Violence Act and the National Instruction on Domestic Violence. Community Involvement • As part of our mandate we do community outreach programmes especially to Rural Communities. The following Communities were visited • Debruk • Siga • Lebotlwana • Skulpadfontein • Ikageng • Makwassie hills • Kanana • Mabopane • Ga-rankuwa • Petsidisulejang • Stilfontein
PROJECTS UNDERTAKEN • Task Team Project The community of Ga-rankuwa and Mabopane approached the office of the MEC for Safety and Liaison to complain about service delivery at their Police Stations. The MEC requested the ICD to be part of a Task Team to investigate these complaints. The ICD conducted a survey in Mabopane and Ga-rankuwa with the assistant of the CPF ‘s. Recommendations were forwarded to the Task Team. The Team agreed with recommendation by the ICD. One of the recommendation was that the Station Commissioner at Ga-rankuwa Police Station be removed since he was perceived to be racist in terms of the feed back from the survey. The Station Commissioner was redeployed. • DVA Workshops. One of the problems we have in the area of our operations is lack of proper implementation of the Provisions of the Domestic Violence Act and the National Instruction on Domestic Violence by members of the SAPS. In order to address this problem we conducted DVA Workshop in all three policing Areas in the Province, with the approval of the Provincial Commissioner. We targeted all managers at the Stations and all Officers at Area level dealing with Domestic Violence, including the Area Commissioners. As a result of the Workshop we see some improvement in the implementation of DVA.
Provincial Challenges • Applications for exemptions are still not received on Domestic Violence Cases. • Returns on Domestic Violence Cases not submitted to the Province by Stations. • There are still some stations that report custody death or death as a result of Police Action late. • Failure to report progress by members • Delays in instituting disciplinary action against members.
