Overview of the Compliance Process Regulatory Background • EPA promulgated and implemented regulations under RCRA to protect human health and the environment. • Based on a variety of information used to develop best management practices for the prevention or minimization of incidents, as well as other requirements. • States can be authorized to implement the RCRA program with oversight by EPA. • Can modify or exclude regulations, but cannot be less stringent. • EPA may still conduct inspections. Protect and improve the health and environment of all Kansans

Overview of the Compliance Process Solid and Hazardous Waste • Solid Waste (Subtitle D) • Relates to design and operation of any solid waste processing or disposal facility, as well as standards for managing other types of solid waste such as: • Medical Waste • Special Waste • Inspections based on known information: • Permit conditions • Facility Operating Plan requirements • Regulatory requirements • Several types of facilities, minimal site specific differences Protect and improve the health and environment of all Kansans

Overview of the Compliance Process Solid and Hazardous Waste • Hazardous Waste (Subtitle C) • Generators, Transporters, Interim and Permitted Receiving Facilities, etc. • Solid Waste, Hazardous Waste, Used Oil, Universal Waste, etc. • Inspections look at many unknown factors: • Site specific information • Regulatory Requirements • May take longer because no two facilities are the same. • Must understand the operation/process • Facility layout • And more Protect and improve the health and environment of all Kansans

Overview of the Compliance Process Why Do We Conduct Inspections? • These regulations are meant to be followed by all who generate, store, transport, treat, or otherwise handle RCRA wastes. • In order to ensure compliance, inspections of facilities are necessary. These inspections are meant to: • Assess how well facilities are complying with these regulations, • Provide assistance with areas of non-compliance, and • Prevent or stop actions which are harmful to the public or environment. Protect and improve the health and environment of all Kansans

Overview of the Compliance Process Why Do We Conduct Inspections? • Inspections are unannounced. • Properly assess day-to-day activities without influence. • Inspectors provide compliance assistance best when they can observe what is happening. • Violations do not always result in enforcement.
