Overview of the 4th Quarter report • This presentation assesses work undertaken by the Institution for the fourth quarter the financial year, starting January to March 2015. • The presentation examines achievement of targets for the reporting period and further give an account of how the institution has performed for the financial year. • The period under reporting was characterised with the finalization of the annual performance plan for the financial 2015/2016 and ensuring that it is adopted by Plenary and tabled in Parliament.

CONSTITUTIONAL MANDATE Constitutional Mandate • S187 (1) The Commission for gender equality must promote respect for gender equality and the protection, development and attainment of gender equality. Additional Powers and Functions prescribed by National legislation • S11 (1) of the CGE Act 39 of 1996 (amended) Monitor Investigate Research Educate Lobby Advise Parliament and report on issues concerning gender equality

CONSTITUTIONAL MANDATE Monitor compliance to Regional & International Conventions • Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000 (PEPUDA) Assist complainants in instituting proceedings in the Equality Court conduct investigations and make recommendations regarding persistent contraventions of PEPUDA

CONSTITUTIONAL OBLIGATION • The Bill of Rights in the Constitution enshrines the rights of all people to the democratic values of human dignity, equality and freedom; and the State must respect, protect, promote and fulfil these rights. • The CGE’s obligation to strengthen constitutional democracy is the attainment of gender equality

VISION and MISSION Vision • A society free from all forms of gender oppression and inequality Mission • Monitor, evaluate and make recommendations on policies of the public and private sector • Information and educational programmes • Evaluate and make recommendations on legislation affecting the status of women • Investigate, resolve and rectify gender issues • Collaborate with government and civil society • Monitor and report on international conventions

Oversight by Commissioners Plenary, 9-11 February 2015 • Considered 3rd quarter reports for Commissioners and Management • Discussions on engaging political parties on the Commission reports • The plight of women farm workers and children • Commissioners met with experts to discuss gender and health, the NGM and Women’s substantive equality Plenary, 6 March 2015 • Engaged and approved APP 2015-2015 and the budget

Oversight by Commissioners Keys issues that Commissioners engaged on • House of Traditional leadership on gender equality matters • Gender Transformation hearings- sexual harassment in the workplace • Preparations on CSW 59 • SAFA- Gun Campaign and discussions on amending the Fire Arms Control Act • Marikana Widowhood legal clinic • Forced and early child marriages • LGBTI communities • Emerging Men’s organisations opposing gender equality- “Backlash from men” • Rural Women’s Movement, the Land Movement of SA on access to land

Oversight by Commissioners • Collaborated with Dept of Agriculture – hosting Men’s dialogue • Have engaged with parliament and Provincial legislatures, Civil Society and Local government • Participated in the C9s Forum, nationally and provincially • National and Provincial Gender machineries meetings • Engagement with PWMSA • Engagement with electronic and print media on gender related matters, viz, virginity testing, Ukuthwala, women representation in political parties and decision-making • Engagement with international and regional bodies on gender • Engagement with Portfolio Committee on CGE reports • Commissioners are deployed in provinces and perform oversight in provincial offices, engage on provincial forums.

Key gender related issues • Key issues surfacing across provinces relate to Estates and Widowhood, there is prevalence of women being chased out of the matrimonial home by family of deceased spouse • Customary issues • Maintenance problems were still highlighted in this quarter again, this has surfaced legal clinics. • Gender-based violence and gender discrimination have been found to be rife in communities. • Provinces have further highlighted that most of the complainants calling in for assistance on protection orders and domestic violence. • The high rate and brutality of gender based violence can further be seen when examining the criminal cases that are currently being monitored by legal officers.

Key findings on reports Gender Barometer report • Emphasis is still concentrated on balance on numbers and not substantive equality Report on the GBV Council • Council is marginalised and excluded from key activities related to its mandate of coordinating national programmes and strategies on gender-based violence • DSD is now responsible for coordinating national programmes and strategies on GBV

STRATEGIC OBJECTIVES Strategic Objective 2 • To protect and promote gender equality by engaging with relevant stakeholders to educate and raise awareness on issues of gender equality, challenge patriarchal perceptions and stereotypes and take action against infringements of gender rights through the implementation of appropriate redress Planned outcome: A society educated in constitutional rights to gender equality that demonstrates the transformative behaviour of the obligation to respect and uphold gender equality. To further ensure effective and efficient application of social justice fro victims of gender violations

Issues surfaced through interventions • registration of customary marriages especially in rural areas • Faith-based organisations are not eager to engage on issues of sexuality and sexual orientation • Some traditional leaders do not want to engage on customary practices that impact on the achieving gender equality • Witchcraft killings have surfaced in Limpopo • Widows face challenges relating to inheritance and estates • Access to land ownership remains a challenge

STRATEGIC OBJECTIVES Strategic Objective 3 • To monitor state compliance with regional and international conventions, covenants and charters which have been acceded to or ratified by the Republic, relating to the objects of the Commission Planned outcome: Assessment of state compliance with regional and international commitments that promote gender equality recommendations tabled with parliament

  35. Conclusion The above represents an overview of work undertaken for the last quarter of the 2014/2015 financial year. There has been improvements in terms of the targets achieved, including improving on the weaknesses that were previously highlighted by the AGSA.
