  2. The author was trying to convey that Maryland wanted to regulate its own taxes. Maryland wanted state government to have more power than the federal government.

  3. Background • Fed government started a bank • Maryland started taxing the bank • McCulloch doesn’t pay the tax • Maryland won in Maryland Supreme Court • Case appealed to U.S. Supreme Ct

  4. Case • Year of Decision: 1819 • Chief Justice : John Marshall • Decision: It was a unanimous decision that the Congress had powers to incorporate the bank, and Maryland could not tax the instruments of federal government. • State has the power to tax its state subjects ONLY.
