DecreeLaw No. 376/2007 of 8 Novemberadopts the measures that are necessary to ensure the implementation of Regulation (EC) No. 1082/2006 of the European Parliament and Council, of 5 July, on European groupings of territorial cooperation and defines: • Who can be a Member of an EGTC • What are the Organs of an EGTC • What are the procedures for the approval of an EGTC
Who can be memberof an EGTC: The State, through the services and entities it encompasses in direct and indirect administration, respectively; Local authorities; Inter-municipalauthorities; Metropolitanareas; Public law entities, as described in Article 1, Paragraph 2, Point 9 of 2004/18/EC Directive, of the European Parliament and Council, of 31 March, about the coordination of processes of adjudication of public works contracts, public supply contracts, and public service contracts. It is also possible for associations constituted by the entities belonging to one or more of the categories referred above.
Any EGTC constituted in accordance with Portuguese law must have the following organs: • a General Assembly, in which all members of the EGTC are represented; • a Director, who represents the EGTC and acts in its name; • a Fiscal Council. • The statute may provide for other organs, as long as their competences are defined clearly.
Procedures Entities aiming to participate in an EGTC must notify the Financial Institute for Regional Development (IFDR), I.P., of their intention. This notification must be undertaken with the following elements: A copy of the proposed agreement, elaborated in accordance with Article 8 of Regulation (EC) No. 1082/2006, of the European Parliament and Council, of 5 July; A copy of the draft statutes, elaborated in accordance with the relevant national legislation and with Article 9 of Regulation (EC) No. 1082/2006, of the European Parliament and Council, of 5 July; Complete information about the identity, nature, and limited or unlimited liability of the members of the EGTC, and about their respective functions within the future EGTC; An explanatory record of the future activity of the EGTC, the way in which it proposes to strengthening economic and social cohesion within the European Union, and the legal framework covering the functions of the Portuguese members of the EGTC, with reference to the territorial cooperation competences established in national law; Indication of the operative period of the future EGTC.
Procedures Once the notification has been accepted, the IFDR, I.P., proposes to the Member of the Government who is responsible for regional development, a consultation to be held with the Member of the Government responsible for foreign affairs, and with those Members of the Government with responsibilities of the matters covered by the EGTC, so that these may verify, respectively, the conformity of the draft agreement with European community law and the international commitments of the Portuguese State, as well as with domestic law. The Members of the Government that are consulted must pronounce themselves about the draft agreement no later than a month after receiving it. The decision about the participation of an EGTC must be taken, and the interested parties notified, no more than three months after the date of the reception of an admissible candidacy.
The functions of any EGTC that is legally based in Portugal may cease as a result of a decision by a member of the Government responsible for regional development, if that EGTC has ceased to fulfil the requirements established in Article 1 (2) or Article 7 of Regulation (EC) No. 1082/2006, of the European Parliament and Council, of 5 July, or if it has violated any Portuguese legal disposition that threatens the continuation of the activities of the EGTC on national territory. The constitution of an EGTC is published in the Portuguese official journal.
Considering the importance of the EGTC within the cross border cooperation the Spanish and the Portuguese Government established Recommendations for the constitution of an Iberian EGTC - September 21th, 2009 • Is appropriate to set up an EGTC when, starting from the human, social and economic situation of the Territories concerned, this new instrument brings an added value and is considered to be more effective than other mechanisms for cooperation to pursue concrete objectives recommended in the Constitutive Act. The proposed establishment of an EGTC will therefore highlight the increased effectiveness of this cooperation instrument, vis-à-vis other possible, to pursue the goals advocated in its constitutive act.
Cross-border cooperation objectives of the EGTC should have a strategic nature and be defined concretely and clearly, and be oriented to exercise an influence on the competitiveness of territories, in the quality of life of the citizen and, consequently, increasing territorial cohesion. • It is recommended to identify in each of the Territories concerned partners with the necessary skills for the attainment of the objectives of territorial cooperation, ensuring that the EGTC streamline partnerships to promote competitiveness of territories. • Considering the cost, in time and political capital, of the creation of an EGTC, it is recommended (but this is not laid down in legislation) to fixe a reasonably long duration, e.g. 5 years
It is recommended to follow a criterion of parity and balance in respect of the location of the Head Office of the EGTC, with the aim of achieving a number roughly equal in both countries. • It is considered advisable rotating presidencies of each EGTC, corresponding the first normally to the country in which is not situated the EGTC headquarters. • The EGCT can promote their activities with or without public co-financing. When an EGTC promotes activities with Community funding, the EGCT will be a beneficiary and does not participate in the OP management.
