  2. 2010 Legislation FPO Amendment: THE DEPARTMENT MAY SUSPEND OR REVOKE THE LICENSE OF A FOREST PRODUCT OPERATOR FOR FAILURE TO COMPLY WITH THIS SUBTITLE. Woodland Incentive Program: [Is not receiving or using federal funds for implementation of an approved practice on the same acre of land or lands described in the application]

  5. Why??? Subtitle 17 WATER MANAGEMENT Chapter 01 Erosion and Sediment Control Authority: Environment Article, §§ 4-101, Annotated Code of Maryland (2) "Agricultural land management practices" means those methods and procedures used in the cultivation of land in order to further crop and livestock production, and conservation of related soil and water resources. Logging and timber removal operations may not be considered a part of this definition.

  6. 50 + 2 Rule SMZ Width 50 feet + (2 feet x % slope) = SMZ width (To A Maximum Of 150 Feet)

  7. Foresters are OK Plan Certification In addition to engineers, land surveyors, landscape architects, architects, FORESTERS are now authorized to prepare plans. (Limited to logging S&E plans only.)

Standard Plan Standard Erosion And Sediment Control Plan: This plan has been revised to state explicitly that it is intended to be used on sites: • That contain no waters of the state, or • Where the plan explicitly states that uncut SMZ will be maintained and roads trails and equipment will be prohibited in the SMZ. And, • Road cuts and fills are 3 feet or less (5 feet in Garrett, Allegany, Washington, and Frederick counties); • Grades for haul roads do not exceed 15 percent; • Landings are located on slopes 10 percent or less; and • Grades for skid trails do not exceed 20 percent.

Waters of the State Waters Of The State (1) Both surface and underground waters within the boundaries of this State subject to its jurisdiction, including that part of the Atlantic Ocean within the boundaries of this State, the Chesapeake Bay and its tributaries, and all ponds, lakes, rivers, streams, storm drain systems, public ditches, tax ditches, and public drainage systems within this State, other than those designed and used to collect, convey, or dispose of sanitary sewage; and (2) The flood plain of free-flowing waters determined by the Department of Natural Resources on the basis of the 100-year flood frequency. For the purposes of defining where on a forest harvest operation a streamside management zone must be established, waters of the State does not includethe 100-yr floodplain, PDAs, natural and man-made systems that convey stormwater runoff only in direct response to precipitation events, and certain other man-made ditches specifically granted a variance and are located in Caroline, Dorchester, Somerset, Wicomico, or Worcester counties, and approved by the appropriate plan approval authority (the SCD).

  10. SMZs SPECIFICATIONS FOR STREAMSIDE MANAGEMENT ZONE (SMZ) SMZs shall be marked and maintained on all sides of waters of the State. For the purposes of establishing the limits of the SMZ, waters of the State shall not include the 100 year floodplainand natural and manmade systems that convey stormwater runoff only in direct response to precipitation events. All waters of the State must be protected for water quality. k. The objective of the SMZ is to maintain an effective wooded buffer. • 60ft2/ac of 6” dbh • SMZ may be clearcut. (as per a Custom Plan with “perimeter controls”) Acceptable perimeter controls include: • approved vegetated buffer of a specified width; • an earth berm; • straw bale dike; • silt fence; or • other practicesthat may be approved by the SCD.

  11. Man-Made Ditches Man-made Ditch: a conveyance primarily constructed in order to and is serving to drain surface water, groundwater, or both. These typically occur as a network of interlaced shallow channels in agricultural fields. These structures are not a straitening, widening or deepening (hydrologic modification) of perennial streams. Typically, these ditches lack perennial flow (i.e. flow only in response to a rainfall event), do not show natural stream features, and lack an aquatic community. Man-made ditches may be referred to as ephemeral channels.
