Environmental Planning in Germany • Germany is a Federation consisting of 16 federal states (Länder) • Federation provides legislation on the field of environment protection • Implementation and enforcement is task of the Länder • Environmental Planning not mandatory • Baden-Württemberg is the only federal state with an environment plan • Reason: Governments are reluctant in committing itself on long term objectives • Action plans in the eighties

Environment Plan Baden-Württemberg • Environment plan (EP) is political guideline • Thorough analysis of state of the environment, problems and causes • Setting of objectives • Describe ways and means to achieve the objectives • Names the responsible parties, timetable and potential costs • First issued in 2001, update in 2007

Environment Plan Baden-Württemberg • Provisions for controlling • Aims at a consensus between interest groups • Competent authority: Ministry for the Environment • Technical assistance (data, analysis): Environment Protection Agency LUBW, research institutes • Participation process of stakeholders

Controlling • Environment reporting system • Every three years the LUBW edits fact and figures on the environment for Baden-Württemberg (lubw.baden-wuerttemberg.de). • These include an analysis and assessment of the findings. • Counselling by a high rank „sustainability council“ • Evaluation and discussion in public and parlament

Structure and organisation of the planning process • Project management: Umweltministerium ---- LUBW • Interministerial working group (state chancellery, economics, rural affairs social affairs) • Sustainability council (high level experts from science, business, social sector) • Round tables (associations, NGOs, local authorities) • Expert working groups – inhouse and external

  8. Integration into other plans • Vertical: Takes into account objectives set out by • EC (former environmental actions plans; EC sustainability strategy) • German federation: sustainability strategy Baden-Wuerttemberg

Integration into other plans • Horizontal: • Part of sustainability strategy Baden-Württemberg • EP contains the Government‘s environmental political guidelines – has to be considered in the overall state land use planning, regional spatial planning • Basis of environmental assessment of EC operational programme of structural funds • Sets objectives for sectoral environmental plans, such as waste management plan, clean air action plans, climate change, noise abatement

  13. Influence on projects • EP does not include certain projects • EP influences indirectly the appraisal and approval of projects • Fund for implementing the EP 2 mio. Euro / year • Fund for implementing the SD-strategy 2,5 mio. Euro / year during a 4 year period • EC structural funds: 6,5 mio. Euro / year during a 7 year period • Water protection 85 mio. Euro / year
