Subpart A - Applicability Requirements applicable: • Operation of any Civil Helicopter • Commercial Air Transportation • Operator in a JAA Member State Exception: • Helicopter used in military, customs and police services • Parachute dropping and fire fighting • Flight immediately before, during or after an aerial work.

  11. Subpart B JAR-OPS 3.010 Exemptions • Exceptional and Temporary • When necessary in order to ensure an acceptable of safety.

  12. Subpart B JAR-OPS 3.015 Operational Directives • Operation shall be prohibited, limited or subject to certain conditions by OD • OD state: • The reason for issue • Applicability and duration • Actions required by the operator.

  13. Subpart B JAR-OPS 3.025 Common Language • All crew members can communicate in the a common language or other means acceptable to the authority. • All operation personnel understand the language in which the Operations Manuals is written.

  14. Subpart B JAR-OPS 3.035 Quality System • Introduction of a Quality System including a Quality Assurance Programme, • Designation of a Quality Manager acceptable by the Authority who have direct access to the Accountable Manager.

Subpart B JAR-OPS 3.037 Accident Prevention and flight safety programme • It is mandatory for an operator to establish an accident prevention and flight safety program, • An occurrence reporting Scheme – Evaluation of Accidents and Incidents BUT not to attribute blame • It may be integrated with the Quality System.

Subpart B JSSI in connexion with JAR-OPS 3.037 • The JAA have set-up the Joint Strategy Safety Initiatives, with NAAs and IPAP, including 2 approaches: • “Classical” flight analysis and • a “predictive” approach involving the whole aeronautical system, trying to evaluate the effects of the quick and numerous changes in Aviation, “Future Hazards”.

Subpart B JSSI in connexion with JAR-OPS 3.037 • Those 2 approaches : • One approach based on accidents and incidents analysis have identified 7 focus areas • The future hazards approach (Predictive Approach) based on identification of changes in the aviation system are complementary Cooperation with Eurocontrol, ICAO, US CAST, insures wide information and efficiency. • CAST (Civil Aviation Safety Team): in charge of the first approach • JSSI: in charge of the “Predictive Approach”.

  21. Subpart B JAR-OPS 3.065 Weapons and Munitions of War • Approbation • Approval of all States concerned necessary for transportation of weapon and munitions of war by air • Limitations • Stowing • Location on board.

  22. Subpart B JAR-OPS 3.070 Sporting Weapons and Ammunitions • Information • The Operator has to be informed • Limitations • Stowing • Ammunitions may be carried in passengers’ checked baggage.

  23. Subpart B JAR-OPS 3.085 Crew Responsibilities • Responsible for the proper execution of his duties • Requirement to report malfunctions, defects and incidents affecting safety unless reported by another crew member. • Capable to perform duties (no alcohol or drugs).

  24. Subpart B JAR-OPS 3.085 Crew members must not fly: • Under the influence of drugs; • Following deep water diving • Following blood donations.

  25. Subpart B JAR-OPS 3.085 Crew members must not : • Fly if the crew member is in doubt of his ability to accomplish his assigned duties or if knowing or suspecting that he is suffering from fatigue or feels unfit to the extent that the flight may be endangered • Consume alcohol less than 8 hours prior to reporting for flight duty or standby nor consume alcohol during a flight duty period nor whilst on standby.

Subpart B JAR-OPS 3.085 Commander’s Powers • Have authority to give all commands, • Have authority to disembark any person or item of cargo which may present a potential hazard, • Not to allow persons to be carried who are so intoxicated by alcohol/drugs that safety may be endangered, • May refuse transportation of inadmissible passengers, persons in custody or deportees if safety may be endangered.

Subpart B JAR-OPS 3.165 Leasing • Leasing between JAA Operators • Wet lease: the lessor remains the operator • Dry lease : JAA Operator (lessee or lessor) must obtain Authority approval • Leasing between a JAA Operator and any other entity • Dry lease-in or wet lease-in: JAA operator must obtain Authority approval • Dry lease-out: to any operator of a state signatory of Chicago Convention • Wet lease-out : JAA operator remains the operator of the aeroplane • Leasing at short notice
