BAAPS Malpractice Insurance Nigel Mercer President of The British Association of Aesthetic Plastic Surgeons (BAAPS) and of The European Association of Societies of Aesthetic Plastic Surgery (EASAPS)
Background Malpractice has been the single biggest issue in BAAPS. The defence organisations have not been prepared to talk about levels of insurance. European insurers were approached and replied “NON!” Other brokers have offered a level of cover far below the type of policy offered by existing providers. Colleagues on the ASAPS Board pay the same as us in Dollars yet earn much more.
Salaries of Attending Surgeons in year 1 in the USA (2008) (BMJ 2009;338:b2637, from Medical Group Management Association) Neurosurgery $445,000 Orthopaedics $375,000 Cardiology $350,000 Vascular surgery $300,000 General medicine $150,000 Paediatrics $125,000 United Kingdom NHS $121,000
Background THE HMG COMPLAINT The information collated and supplied to the ASA in defence of the BAAPS advert included a 188 page document including; a) BAAPS audit data for breast augmentation b) The Clinical Risk papers published 10 days ago C) Evidence of the “Safety” message which underpins BAAPS. • We were able to show that BAAPS surgeons have a lower complication rate than published series.
Background The advent of a ‘Re-operation’ insurance product in 2009. Discussions with the team supplying that product concerning malpractice insurance. The introduction of a specialist broker and underwriter (NB This is not Beautysure product). All combined to allow BAAPS to explore a new form of mal-practice insurance.
The Cover Under written at Lloyds Written only for BAAPS members. 1 million pounds cover (Higher on request). Risk is individualised. On the same basis as existing policies including; Clinical negligence Legal fees Awarded settlements GMC and coroner's hearings Seven days a week expert medico-legal advice Cover maintained for the legal time required after retirement
The Cover Additional cover will be provided on an individual basis for; Libel or defamation actions Medico-legal work Overseas working (teaching, charity work and commercial surgery)
The Cover Savings from ’Re-operation' Insurance. An excess may be applied. BAAPS aims to introduce a top up policy held by the whole group in year 2 (eg. 10 million pounds for 2 events in a 2 year period). BAAPS members will no longer be cross indemnifying untrained cosmetic practitioners
