Background – Statement of Intent to Build • Starting with the new resource qualification review for the seventh Forward Capacity Auction (FCA #7), the ISO created the Officer’s Statement of Corporate Intent to Build to support the consultation process between the ISO and Transmission Owner(s) on whether or not transmission upgrades associated with new generation capacity can be completed in time for the start of the Capacity Commitment Period (CCP) as described in Market Rule 1, Section III.13.1.1.2.3 and PP-10, Section 5.9 • Officer’s Statement concurs that the transmission upgrade is achievable in time for the relevant CCP and the intention to build the upgrade should the new resource(s) clear in the associated Forward Capacity Auction • Does not create any liability on the officer • Any liability with respect to the Transmission Owner’s obligations shall be as set forth in the Transmission Owner Agreement (TOA) • Does not establish the party whom is financially responsible for the upgrade

Statement of Intent to Build Process Timeline Each year around the middle of July, the ISO will provide the Transmission Owner(s) the preliminary list of overloads that resulted or were worsened from the addition of new generating capacity in their territory Concurrently, the ISO will also provide the Project Sponsor with the preliminary list of overloads that resulted or were worsened due to the addition of their project The Transmission Owner, in consultation with the Project Sponsor, reviews their list of overloads and will provide to the ISO no later than 30 calendar days after receiving the preliminary list an Officer’s Statement of Corporate Intent to Build when the transmission upgrade(s) can be achieved in time for the relevant CCP After receiving the Officer’s Statement, the ISO will review the information on the transmission upgrade and determine whether it could or could not be implemented in time for the relevant CCP

PP-10 Updates – Statement of Intent to Build • Section 5.9 – Supplemental Guidelines for determining if a Transmission Upgrade could or could not be implemented in time for the Capacity Commitment Period • Insertion of a paragraph regarding the Officer’s Statement of Corporate Intent to Build • New Appendix – Sample Officer’s Statement of Corporate Intent to Build

PP-10 Updates – Other Changes • Section 2 - Timeline • Update that the specific due dates associated with timelines can be found on the ISO New England website and in the Forward Capacity Tracking System (FCTS) • Section 7 - Analysis of De-list Bids, Demand Bids, and Non-Price Retirement Requests • The submittal of Non-Price Retirement Requests will be via FCTS starting with FCA #9 • Appendix C • Update the sample Show of Interest Application for Generating Resources to add if the Project is FERC/Non-FERC jurisdictional • Administrative corrections

  6. Timeline • Discuss red-line PP-10 changes at the April 16 RC Meeting • Vote at the May 20 RC meeting • Vote at the June 6 NPC meeting • All changes to be effective for the FCA #9 qualification process
