REQUEST FOR RECORDS 11/11/2022 Haugen to Congress and the SEC on the subject of Facebook and Instagram leading people (and particularly children and teenagers) to experience depression and thoughts of suicide; [13] your discussions about the documents provided by Frances Haugen to Congress and the SEC on the subject of Facebook destabilizing foreign countries by stoking ethnic and religious tensions; [14] your discussions about the October 05th 2021 testimony of Frances Haugen before the United States Senate Subcommittee on Consumer Protection Product Safety, and Data Security; [15] your discussions about the decision Senator Richard Blumenthal (D-CT) to recognize that Facebook is “morally bankrupt;” [16] your discussions about the decision of Senator Richard Blumenthal to recognize (on October 05th 2021) that Facebook has maliciously withheld records he and Senator Marsha Blackburn (R-TN) have previously asked for; [17] the extent of your knowledge on whether Senator Richard Blumenthal (personally, through his staff or his legal representatives) initiated contact with the SEC about Facebook business practices; [18] your discussions about the decision of Senator Marsha Blackburn to recognize (on October 05th 2021) that children below the age of 13 (thirteen) are on Facebook even though they are prohibited from being so; [19] your discussions about the decision of Senator Edward Markey (D-MA) to recognize (on October 05th 2021) that Facebook (as a for-profit company) wanted children under the age of 12 (twelve) to be able to join the social network since Calendar Year 2012; [20] your discussions about Frances Haugen as a former employee of Facebook, who has stated before Congress (on October 05th 2021) that she would be in favor of increasing the minimum age to join Facebook from 13 to 16 (sixteen) and/or 18 (eighteen); [21] the formal/informal opinion of your local/state/federal government on increasing the minimum age to join Facebook from 13 to 16 and/or 18; [22] your discussions about the mental health benefits of increasing the minimum age to join Facebook from 13 to 16 and/or 18; [23] your discussions about the 1998 Child and Teens Online Privacy Protection Act (COPPA) prohibiting in general for “an operator of a website, online service, online application, or mobile application directed to a child or minor (…) to collect personal information from a child or minor;”vi [24] the extent of your knowledge on whether Senator Edward Markey initiated contact with the Federal Trade Commission (FTC) on the subject of Facebook increasing the minimum age to join Facebook from 13 to 16 and/or 18; [25] the formal/informal opinion of your local/state/federal government on the findings of Congress, which concluded that (i) children increasingly consume digital entertainment on the internet and are uniquely susceptible to manipulation online, given their lack of important neurological and psychological capabilities, (ii) today’s digital media environment is constantly evolving and now includes high-tech experiences, such as augmented reality and virtual reality, (iii) today’s digital media environment is largely designed in non-transparent ways to ensure children interact with content that reflect the interests and goals of content producers, online platforms, and marketers, (iv) online companies gather, analyze, and use data for behavioral marketing directed at children, (v) companies employ sophisticated strategies, including neuromarketing to affect consumer behavior and manipulate online users’ decision making, (vi) branded content in various forms of multimedia, including native advertising and influencer marketing, exposes children to marketing that is inherently manipulative or purposely disguised as entertainment or other information; [26] the formal/informal opinion of your local/state/federal government on the Kids Internet Design and Safety Act (KIDS Act); vii [27] your discussions about the findings of Congress, which concluded that (i) online platforms have become integral to individuals full participation in economic, democratic, and societal processes, (ii) online platforms employ manipulative dark patterns, collect large amounts of personal information from their users, and leverage that personal information for opaque algorithmic W (AACL) – MICHAEL A. REQUEST FOR RECORDS 11/11/2022 processes in ways that create vastly different experiences for different types of users, (iii) algorithmic processes are often used by online platforms without adequate testing and in the absence of critical transparency requirements and other legally enforceable safety and efficacy standards, which has resulted in discrimination in housing, lending, job advertising, and other areas of opportunity, (iv) the use of discriminatory algorithmic processes causes disproportionate harm to populations that already experience marginalization, (v) online platforms constantly engage in content moderation decision making, resulting in highly influential outcomes regarding what content is visible and accessible to users, (vi) online platforms contents moderation practices have disproportionately significant repercussions for members of marginalized communities, who have historically been the target of nefarious online activity, including disinformation campaigns, (vii) users of online platforms should have access to understandable information about how online platforms moderate content and use algorithmic processes to amplify or recommend content, (viii) users of online platforms should be able to easily move their data to alternative online platforms, and the importance of this right is particularly significant given certain online platforms use of harmful algorithmic processes and engagement in ineffective content moderation, (ix) algorithmic processes facilitate discriminatory outcomes on online platforms that individuals may not personally interact with, but which nonetheless process personal information of such individuals and have significant, negative consequences, (x) the people of the United States would benefit from the convening of experts from a diverse set of governmental positions to collectively study and report on discriminatory algorithmic processes across the United States economy and society, with particular attention to intersections of harm; [28] the formal/informal opinions of your local/state/federal government on the Algorithmic Justice and Online Platform Transparency Act;viii [29] your discussions about the decision of Facebook to change its company name to Meta less than 4 (four) weeks after Frances Haugen Congressional testimony to the Subcommittee on Consumer Protection, Product Safety, and Data Security; ix [30] your discussions about Elon Musk takeover of Twitter on or around October 28th 2022; [31] your discussions about the finding of Montclair State University, which concluded that the prospect of Elon Musk takeover of Twitter had increased misinformation, extremism and hate speech on the platform between October 21st 2022 and October 27th 2022; [32] your discussions about the finding of Montclair State University, which concluded that Elon Musk confirmed takeover of Twitter (on October 28th 2022) exacerbated misinformation, extremism and hate speech on the platform; x [33] your discussions about the finding of the Network Contagion Research Institute, which concluded that the use of the derogatory word “N****r” had increased by nearly 500% (five hundred percent) in the 12 (twelve) hours immediately after Elon Musk takeover of Twitter; xi [34] your discussions about Elon Musk takeover of Twitter having inspired many conversations around the world on the threat posed by this individual to democracy in America and around the globe; xii [35] your discussions about the decision of Elon Musk to re-tweet misinformation about the physical attack Paul Pelosi was subjected to at his home in San Francisco (California) on (or around) October 28th 2022;xiii [36] your discussions about the reasons why Elon Musk opted to re-tweet misinformation about the physical attack Paul Pelosi was subjected to in San Francisco (California) on (or around) October 28th 2022;xiv [37] your discussions about David DePape as a Caucasian man, who is (as of this writing) charged with the attempted murder of Nancy Pelosi’s husband, Paul Pelosi (on or around October 28th 2022); [38] your discussions David DePape as a Caucasian man, who came to the U.S in March 2008 as a temporary visitor from Canada; [39] your discussions about David DePape as a Caucasian man, W (AACL) – MICHAEL A. Ayele (a.k.a) W after reviewing his appeal; xviii [49] your discussions about the decision of the Consumer Product Safety Commission (CPSC) to recall Tesla Cyberquad for Kids for failing to “comply with the federal mandatory safety standard requirements for youth ATVs, including mechanical suspension and tire pressure.”xix II) Request for a Fee Waiver and Expedited Processing The requested records do/will demonstrate that [1] Frances Haugen is a Caucasian woman who (i) has earned a Bachelor’s Degree in Electrical and Computer Engineering from Olin College, (ii) has earned a Master’s in Business Administration (MBA) from Harvard University; [2] Frances Haugen is a woman who (i) began working for Facebook sometime in 2018/2019 after she was contacted by a recruiter of the company, (ii) agreed to work for Facebook on the condition that she would tackle misinformation on the company’s platform, (iii) who became disillusioned about her roles and responsibilities within Facebook shortly after joining the company as an employee, (iv) met with her direct supervisor for the purpose of doing the work Facebook hired her to do, (v) became even more frustrated after meeting with her direct supervisor to discuss the work Facebook hired her to do, (vi) ended up disclosing tens of thousands of documents to the Securities and Exchange Commission (SEC) as well as Congress in Calendar Year 2021, (vii) testified before Congress on October 05th 2021 about several aspects of her employment with Facebook (viii) is in favor of increasing the minimum age to join Facebook from 13 to 16 and/or 18; [3] Facebook is a for-profit company that has (i) changed its name to Meta less than 4 weeks after Frances Haugen testified before Congress on October 05th 2021, (ii) led people to experience depression and thoughts of suicide, (iii) that has destabilized foreign countries by failing to moderate hate speech on its platform, (iv) been called “morally W (AACL) – MICHAEL A. REQUEST FOR RECORDS 11/11/2022 bankrupt” by former employee Frances Haugen as well Senator Richard Blumenthal, (v) been accused by Senators Richard Blumenthal and Marsha Blackburn of maliciously withholding documents asked for by Congress; [4] Elon Musk has taken over Twitter on or around October 28th 2022; [5] the prospect of an Elon Musk takeover of Twitter had increased misinformation, extremism and hate speech on the platform between October 21st 2022 and October 27th 2022 (according to Montclair State University); [6] the use of the derogatory word “N*****” had increased by nearly 500% in the 12 hours immediately after Elon Musk takeover of Twitter on October 28th 2022; [7] Paul Pelosi is a Caucasian man, who was physically assaulted at his place of residence in San Francisco, California on October 28th 2022: the same day Elon Musk finalized his takeover of Twitter; [8] Paul Pelosi is a man who was more likely than not physically assaulted on October 28th 2022 by David DePape; [9] David DePape is a Caucasian man who came to the U.S in March 2008 as a temporary visitor from Canada; [10] David DePape is a Caucasian man who is being held at the San Francisco County jail for the attempted murder of Paul Pelosi as well as other criminal charges; [11] the Department of Homeland Security (DHS) Immigrations & Customs Enforcement (ICE) have issued an “immigration detainer on David DePape;” [12] Michael A. Ayele (a.k.a) W is a Black man, who was a little taken aback by the graphic content of the articles published by the Los Angeles Times on the subject of the criminal charges levied against David DePape for his physical assault of Paul Pelosi (on or around October 28th 2022); [13] Michael A. Ayele (a.k.a) W is a Black man, who has had his official website on WordPress reinstated a day after he had filed an appeal with the website hosting and publishing platform; [18] WordPress is a website hosting and publishing platform that has reinstated the official website of Michael A. Ayele (a.k.a) W on October 29th 2022 and issued an apology for the temporary suspension; [19] Michael A. Ayele (a.k.a) W is a Black man, who has never denied being employed with the MODMH in Calendar Year 2013 on the rare occasions he was asked about his employment there; [20] the MODMH is a state agency that doesn’t deny that Michael A. Ayele (a.k.a) W was employed as a Forensic Rehab Specialist (FRS) at the Fulton State Hospital (FSH) in 2013; [21] the MODMH is a state agency that doesn’t deny that Michael A. Ayele (a.k.a) W was originally assigned to the Program for Recovery Initiation & Self- Motivation (PRISM) at the now defunct Biggs Forensic Center (BFC) in 2013; [22] the MODMH is a state agency that doesn’t deny that Michael A. Ayele (a.k.a) W stopped being assigned to the PRISM at the now defunct BFC in 2013 after he vocally disapproved being called a “N****r” at the Fulton State Hospital (FSH) by patient/prisoner James White; [23] the MODMH is a state agency that doesn’t deny that Michael A. Ayele (a.k.a) W was subjected to an internal state investigation between October 26th 2013 and November 21st 2013 after he publicly and vocally objected to being called a “N****r” at the workplace; [24] Michael A. Ayele (a.k.a) W is a Black man, who came to the United States of America (U.S.A) in December 2009 on an F-1 Visa for the purpose of pursuing his undergraduate degree with Westminster College (Fulton, Missouri); [27] Michael A. Ayele (a.k.a) W is a Black man, who has graduated from Westminster College (Fulton, Missouri) with majors in Economics and Political Science on December 31st 2016; [28] Michael A. Ayele (a.k.a) W is a Black man, who has corresponded with the Department of Homeland Security (DHS) Immigrations & Customs Enforcement (ICE) about Westminster College (Fulton, MO); [29] the DHS (ICE) have disclosed to Michael A. Ayele (a.k.a) W their formal and informal ties with Westminster College (Fulton, MO). xxi In my judgment, the facts presented in my request for a fee waiver and expedited processing are not the sort to bolster public confidence in the activities of the U.S government as well as social networks such as Meta and Twitter. As a Black man with a U.S college degree, I would like to take this opportunity to [1] denounce the use of the hateful term “N****r” at the workplace, on social networks and everywhere else; [2] denounce the physical assault Paul Pelosi was subjected to at his place of residence in San Francisco, California (on or around October 28th 2022); [3] express grave concerns about the employment of Frances Haugen with Facebook; [4] denounce discrimination, racism and sexism at the workplace pursuant to Title VII of the 1964 and 1991 Civil Rights Act; [5] express grave concerns about the impact of Facebook/Meta on children and teens mental health; [6] express grave concerns about the disastrous impact of Facebook/Meta in foreign countries around the globe; [7] express grave concerns about Elon Musk emboldening racists and sexists on Twitter; [8] express grave concerns about hate speech on Twitter. The core issues presented in this records request are as follows. 1) What formal/informal ties exist between your office, the Consumer Product Safety Commission (CPSC), the Department of Homeland Security (DHS) Immigrations & Customs Enforcement (ICE), the Equal Employment Opportunity Commission (EEOC), the Federal Trade Commission (FTC) and the Securities and Exchange Commission (SEC)? Have you had conversations on the subject of Frances Haugen employment with Facebook? Have you had conversations on the subject of Frances Haugen disclosures to the SEC and Congress? If yes, will you promptly disclose those records? 4) Have you had conversations about the Kids Internet Design and Safety Act (KIDS Act)? Have you had conversations about the Algorithmic Justice and Online Platform Transparency Act? If yes, will you promptly disclose those records? 5) Have you had conversations about the research of Montclair State university, which found that the prospect of Elon Musk takeover of Twitter had increased misinformation, extremism and hate speech on the platform between October 21st 2022 and October 27th 2022? Have you had conversations about the finding of the Network Contagion Research Institute, which concluded that the use of the derogatory word “N****r” had increased by nearly 500% in the 12 hours immediately after Elon Musk takeover of Twitter? If yes, will you promptly disclose those records? 6) Have you had conversations about the physical assault Paul Pelosi was subjected to at his home on October 28th 2022? Have you had conversations about the October 28th 2022 arrest of David DePape for the attempted murder and the physical assault of Paul Pelosi? Have you had conversations about the likely reaction of the Republican Party establishment as well as far-right news outlets if Paul Pelosi was physically assaulted by a Black/African American man who was a Republican by political affiliation? If yes, will you promptly disclose those records? 7) Have you had conversations about the October 28th 2022 suspension of Michael A. Ayele (a.k.a) W official website on WordPress? Have you had conversations about the decision of WordPress to reinstate the official website of Michael A. Ayele (a.k.a) W on October 29th 2022? If yes, will you disclose those records? This records request should be expedited because it puts into question the government’s integrity about the way that people are treated in the U.S.A on account of their gender, their racial backgrounds, their national origins, their sexual orientations and their disability status. The decision of the MODMH to withhold these records were not consistent with Missouri state laws including but not limited to 1 Missouri Sunshine Law (Section 630.140, RSMO) as well as Missouri Senate Bill 26 (Section 590.030 & Section 590.502, RSMO). Missouri Revised Statutes (RSMO) Section 590.502 specifically states for instance that law enforcement officers (who have passed a criminal background check with the Department of Justice Federal Bureau of Investigation) who “reasonably believe he or she is under investigation which could lead to disciplinary action, demotion, dismissal, transfer of placement that could lead to economic loss” [1] shall be informed in writing of the existence and nature of the alleged violation and who will be conducting the investigation; [2] shall be provided a “written statement outlining the complaint;” [3] shall be informed that “he or she is being ordered to answer questions under threat of disciplinary action and that the (…) answers to the questions will not be used (…) in a criminal proceeding;” [4] shall be “questioned by up to two investigators and shall be informed of the name and rank of each questioning officer.” For the reasons mentioned above, the AACL regrets the decision of the MODMH to withhold records of Michael A. These terms included are vulgar and hostile towards individuals based on race, religion, ethnicity, and orientation. Collection of the totality of Tweets using these words in the period immediately before and after Musk’s acquisition was done to assess both frequency and the rate with which this content was posted. Tweetbinder’s sentiment analysis tool, which measures positive or negative tone in Tweets, was utilized to assess potential hostility in the collected data. "Mr. Pelosi also conveyed that the man was looking for Mr. Pelosi’s wife, that Mr. Pelosi’s wife was Speaker Pelosi who would not 'be there for days,' and that the man said he would 'wait' for Speaker Pelosi," according to the indictment. When an officer asked what was going on, DePape replied "everything is good" while he used his other hand to "encircle Mr. Pelosi's right arm," the indictment said.
