  4. Guide to implementation of New Approach Directives According to the “Blue” Guide, Directive 98/34 states: • Compliance with CEN or CENELEC standards is not compulsory • Conflicting national standards must be withdrawn

  5. PED Recital 16 “WHEREAS …to ease the task of demonstrating compliance with ESRs, standards harmonised at European level are useful…” CEN, CENELEC are recognised as competent to adopt harmonised standards that follow general guidelines…”

  8. Pressure Equipment Directive Article 5 (2) “Pressure equipment and assemblies which conform to the national standards transposing the harmonised standards published in the OJ shall be presumed to conform to the essential requirements…”

  10. Standards-making Standards elaborating the PED Essential Safety Requirements are: • Precise using known and respected data • Allow flexibility but avoid compromise through stating generalities • Add value • Acceptable to the Mandate These standards are made for the Directive

  11. Foreword in standards Standards which are candidates for citation in the Official Journal state: “For relationship with EU Directive(s), see informative Annex Z, which is an integral part of this document”

PED Annex Z “Once this standard is cited in the OJ under [the] Directive and [it] has been implemented as a national standard in at least one Member State, compliance with the clauses of this standard given in Table ZA.1 confers, within the limits of the scope of this standard, a presumption of conformity with the corresponding Essential Requirements [of the] Directive and associated EFTA regulations.”

Guidelines • Guidelines are not legally binding, but are regarded very highly in most Member States • Kept active when drafting standards • Examples • 9/20 Generic statement rejecting imposed national requirements affecting design etc. • 8/15 specific requirements to be included at design stage, drawn from national rules regarding operation in some member states

  16. Question 1 Can we use standards other than EN in pressure equipment? Answer YES as long as the manufacturer meets the essential safety requirements in the PED. [Commercial considerations may apply ie. the overall cost may be greater]

  17. Question 2 How do I know that AD 2000, CODAP, PD5500, ASME or other non-EN standard meets the Essential Safety Requirements? Answer You do not know, unless the manufacturer: • reviews his arrangements for complying with ESRs and • the Notified Body accepts this, where it is involved in Conformity Assessment.

  18. Question 3 Does this mean that the manufacturer takes on additional responsibility by not using EN? Answer YES – other standards do not confer Presumption of Conformity with the ESRs.

Materials issues: EN/ASME/ASTM PED Annex I clause 4.1 (a) emphasises ductility and toughness, quantified in clause 7.5. • European materials have guaranteed properties of strength [room (and elevated) temperature], ductility and toughness (transverse direction). • American materials standards do not always state these properties and they are not guaranteed. Levels of C, S (and P) are not consistent with good impact properties expected in Europe.

Cautionary preface on some materials standards cited in OJ (Guideline 7/1) For the following harmonised supporting standard for materials, presumption of conformity to the ESRs is limited to technical data of materials in the standard and does not presume adequacy of the material to a specific equipment. Consequently the technical data stated in the material standard should be assessed against the design requirements of the specific equipment to verify that the ESRs of the PED are satisfied.
