  2. 40 USC – US Code – Title 40: Public Buildings, Property, and Works (January 2003)  (a) Required. - Each executive agency shall - (1) maintain adequate inventory controls and accountability systems for property under its control; (2) continuously survey property under its control to identify excess property; (3) promptly report excess property to the Administrator of General Services; (4) perform the care and handling of excess property; and (5) transfer or dispose of excess property as promptly as possible in accordance with authority delegated and regulations prescribed by the Administrator. (b) Required as Far as Practicable. - Each executive agency, as far as practicable, shall - (1) reassign property to another activity within the agency when the property is no longer required for the purposes of the appropriation used to make the purchase; (2) transfer excess property under its control to other federal agencies and to organizations specified in section 321(c)(2) of this title; and (3) obtain excess property from other federal agencies.

Glossary of Terms • Excess – Any personal property under the control of any Federal agency that is no longer required for that agency’s needs or responsibilities, as determined by the agency head or designee. Available for transfer to other Federal Agencies • Report – Notifying GSA of excess property • Screening – Searching for property • Surplus – Available for donation to the SASP (State Agencies for Surplus Property)

  7. Step 1 – Agency: Internal • Follow Internal Procedures First Property Custodians • Property Officers • National Utilization Officer (NUO) • Once internal procedures are complete, • an agency can report property to GSA. • Reference: 41 CFR 102-36.35

  8. Step 2 – Report Property • Notification to GSA of available excess property • Report to GSAXcess® • On-line • Batch • SF 120 – Only accepted if agency does not have internet access. Reference: 41 CFR 102-36.210 through 41 CFR 102-36.240

Must All Excess Property Be Reported to GSA? • Yes, except • Direct Transfer Property; • Abandonment/Destruction Property; • Nonappropriated Fund Property; • Foreign Excess Property; • Scrap (except aircraft); • Perishables; • Hazardous Waste; • Controlled Substances; • Nuclear Regulatory Commission – controlled material; • Property Dangerous to Public Health and Safety; and • Classified or Property Sensitive for Reasons of National Security Reference: 41 CFR 102-36.220
